My argument is based on everything Trudger said being true. If indeed JCT tried to force him to take a load instead of going home, they had no right to and wrongfully terminated his lease. Other L/O's for JCT here have stated they have no issue getting home so it is very possible Trudger's experience was just an anomaly. Which would show even JCT agrees that the Lease ops are in charge of their own ship.

And lest not forget steel tiger and alan also backing up that notion justifing jct firing of an ic for turning down a load and going home......i think alan said its in the contract.....a side note if tbat clause is in the contract it could invallidate the entire ic agreement in my opinion

I look at it this way, If you want to try owning your own truck and fail, and many do, which route would you
rather take as a new business adventure...
Buy your truck with a bank note, or use a walk-away lease?? Yep, everyone thinks they are going to be successful
but many fail both as an O/O making payments on a truck and L/P thru a trucking company..
Most fail from lack of business experience or just get tired of trucking altogether.. Some fail from just bad luck
and others from a bad company experience... Many, Many things can get into the way if you don't have the
experience or resources to recover...
When I bought my first truck in the 70's, I don't think that option was available back then... Neither was
computers, cellphones in trucks.. We used CB's and payphones.. And the help of other drivers willing
to share information...
It is far easier to find information today then it was back then, but as before, watch out for the B/S

a 5 year old truck with 600,000 to 700,000 miles is hardly worthless.
a quick search over at truckpaper shows they are going for between 40k and 55k.

Um, without scrolling back, I don't believe that I ever stated that. To my knowledge, JCT has never fired a driver or terminated their contract because they went home instead of taking a load. Now if that driver did not have scheduled home time, that may be a different situation especially if they already had a pre plan assigned to him. A simple message to his DM staying that he was going home after he emptied out would probably have resolved that issue. Then again, there may be a slew of other issues concerning that driver that we don't know about. Did he have service failures? Was he a difficult driver that refused all kinds of loads? I dunno, maybe. Whether you're a company driver, lease operator, or an owner operator, one key ingredient that is necessary is the ability to work with others.

Does it really matter? If a driver is happy and profitable at JCT, is it really necessary to try and convince them other wise?

Companies like JCT (and others), have been able to profit obscene amounts of money by utilizing the "IC" rule. However, I think the government would like to get some of this money as JCT (and others) are not following IRS rules regarding "IC's."

I believe that there are better options out there. I made good money with jct and still am so I can say I was one of the successful ones here. Do I believe they are ruining a scam. Absolutely not. Do I blame them for being able to make profit off not just loads but leasing trucks, absolutely not. They are in business to make money also. Some drivers may not like the way they run things but they can't say it's a scam because they themselves weren't successful.

One thing I don't agree with is the fact they don't pass through the fuel discount.
As we're picking up the tab for fuel, that discount should be ours. While $20-$30 per hundred gallons may not seem like that big a deal to a solo driver, that adds up to $150 that a team could be saving off their fuel bill per week which makes a huge difference considering it takes us 5500 miles to gross $1100/ea (so, about $700 after setting back our taxes... about what I got paid working for Carolina Cargo).
This new lease program is not team friendly. It's great for solos, though.
