When you are running under your own authority, technically, you are the motor carrier, however, when you are behind the wheel you may be construed by D.O.T. as the driver. I think once they found out you were the owner of the company, there would be nothing said as long as you run under your authority. You can probably get a blank rider form off the OOIDA website. Basically all it does is relieve the carrier of any liability in the event the rider is hurt.

Since you're talking about your wife, not really sure that form would relieve you of that liability anyway?lol It does have required dates from and to for which the form is valid. You might just want to call your local D.O.T Enforcement section and ask them? You may not even need the form. Of course say if you lease your truck to another company, you may have to get a form from them?

The rider insurance policy is just another scam that companies pull on employee or lease operator drivers.

Unless the company policy has a specific clause that states that riders are not covered, their general liability insurance covers riders.

The extra money they collect is just additional profit in thier pockets.

Do you really think having somebody just riding in the truck costs $20-$50 bucks a week or month to insure that person?

Has any passenger died while not approved by the company/insurance?
No agenda, Just curious and can anyone provide a link to the wreck and outcome ?

ETA: Just noticed TankerYankr post above me. I was thinking that, but with an open mind wanted proof and I would not post again :biggrin_25523:

The question I have is can or will an insurance company deny a claim in the event of an accident if an "unauthorized" passenger is present. Has this happened before to anyone's knowledge?

I know a guy who was caught with an authorized passenger and was fired on the spot.

They can deny the claim but still may lose in court(or make a settlement)

Qc said that you can have a passenger but there are rules. You have to permission first with a note from the company allowing the passenger.. Don't get caught with one or you will be fired on the spot!
