Failing a cdl test is one thing, but refusing to let him even test out or try to test out again is where discrimination begins. Once someone is excluded from doing something is where basis of the lawsuit begins. Now if the cdl tester would have said you have to weight a week, then test again that's one thing but to say not to bring him back whole different story

You know what sucks though?? The stupid FMCSA <DOT, Watchdog Groups and ATA enthusiasts STILL think your Going to Be too Heavy at 270 lbs..Even 240 lbs...
lets say your average height for a man (5'9"-5'-10") Doctors,and Such Groups target a Healthy Weight at 160-180 lbs. Can you believe that?
Dont be surprised at 270 lbs that once you Take a POhysical..They'll be concerned with a BMI-Fat Neck syndrome of sorts.......eVEN THOUGH YOU ACCOMPLISHED A GREAT FEAT BY LOSING 100 POUNDS!!

Remember "Tiny"? 5'8, 495 lbs? I went through orientation with Tiny. At the physical, he was bragging to the nurse practitioner about losing 8lbs overnight. She told him that had to be one strenuous #### he took.
He was so big he couldn't step up on a lowboy trailer. He couldn't secure his loads and so he had to pay someone to do it for.
You know, it's funny how you always hear people complain about big government and socialism in one breath, then they say that people who are so fat that they can't touch the brakes, meaning SAFELY DRIVE A CMV, should not be discriminated against. If you can't do the job, you should find something else to do.
"Oh, but they shouldn't turn him away from the only he he could do." You complain about your pay, but think that trucking should be the catch all for the unfortunates. Interesting.
"But they discriminated against a person because he was fat!" This is America. They see plenty of fat people. The Tester was riding shotgun for a wild ride with a guy who could not get the truck to stop because he couldn't brake. Public safety? Yeah, throw that out the windowBet the Tester aged 5 years in 5 minutes. Haven't everything been dumbed down enough? We should make amends for people who are too fat to switch their right foot from the throttle to the brake without opening the door.
When I was on the PD, we had to be physically able to pass the fitness test at the end of the academy. Had to qualify to drive, had to qualify with either hand with firearms. And every year after, we had to pass a physical agility test. Well, so many cops had troubles passing the agility test, that they changed the requirements to every two years. If you can't keep yourself up yearly, a two year agility test will be harder to do. And it was. They had to scrap the whole idea. Firefighters and police that cannot pass a physical agility test should not be public servants. What happens next? Injuries. Bad backs, twisted knees, disability, workmanship comp claims...guess who pays for that?
The military is next. Get rid of boot camp. Get rid of that mean ol drill sargeant. Get rid of discipline. In fact, let's sue the US military for not allowing 500 lb fat people in. I take that back...if a 500 lb person can do the boot camp at a quarter ton, by all means allow him to enter. But if he can't do the job, he needs to find something else to do.

Speaking as someone who is 6'3 and used to weigh 568 pounds, if you can't physically perform a job safely, you shouldn't be doing it. Im now at 455 with a couple hundred more to lose and I will get there.
Weight isn't always the clearest indication of health though. To the amazement of the doctor I have seen regularly for a few years I have no diabetes or even high blood pressure. Even at my highest weight I was pretty active doing land clearing so I was climbing on and off heavy equipment, using a chain saw, running silt or tree protection fencing, etc.. Over the past year Ive been going to the gym regularly. Im also settled in to a ketogenic diet.
The biggest change for me was being diagnosed with sleep apnea a couple of years ago. Since then I have been using a BiPap machine at night and it has changed my life. I had no idea how bad I was sleeping and how negatively it was effecting me. I sometimes wonder if I would have ever gotten as heavy as I was had I been diagnosed sooner.DaddiesBigTruck Thanks this. -
I'd like to see this happen with the students who can't get through their CDL driving exam without someone else doing their shifting (whether the student's weight is a factor or not). I am tired of hearing the same story from multiple people. Ethically, this is not okay. These are the same people who are going to be in the driver's seat (either alone or with a trainer) going through steep country in a few short weeks. Don't hand a CDL to someone YOU KNOW is going to burn brakes, smash into stopped traffic or roll a truck at the first opportunity. Please.Last edited: May 17, 2014

The real danger is Flatulance Agravated Restpiratory Torture ( FART ) for short. I don't wanted a five hundred pounder in the bunk above me farting until we suffocate. Hell I don't even want to be in the truck at all when that wind starts to blow.

Skinny guys can fart, too. The same goes for skinny women (though some are very good at hiding/denying it).

lol. The smell isn't the problem. Ask any pig farmer and they don't even smell it anymore. I'm guessing the problem in an enclosed truck would be the risk of explosion if ignited...
