Broker fee without broker license

    We were pulling a trailer for a company that gave us one way loads and we loaded ourselves the other way. He charged us 1500.00 a month to pull his reefer, and then deducted from us come to find out 178.00 per load. he only has operating authority and no brokers license, can he do this legally? Have searched all over fmcsa and cant find the answer, going to court and need a copy of the law to show to judge as hes received 7200.00 from us for this:biggrin_2554:

    Are you running under his authority while moving his load? When coming back with the load you find under who authority are you running under? Post his DOT number. What kind of contract do you have with this guy? To much info missing.

    We ran under our own authority at all times just pulled his trailer. Don't know his dot number off hand but looked him up and he only has operating authority no brokers

    does he own the freight you hauling for his company?whats the lenght of the haul and how much did it pay?how fast did he pay?from what load did he deduct the $178?

    Don't know what any of that matters but no he didn't own it mileage was 1100 paid in 14 days and he deducted it from the gross

    The way I see it he is illegal broker and you rent a trailer from him for $1500.00 and he takes a cut of the gross of $178.00 I would run away from him as fast as I could before you get burned by him and rent another trailer. He is ripping you off.

    Yea but I am taking him to court and need a copy of the definition of a freight broker and not even motor carriers can tell me where to find it :(

    the reason why i asked is because i dont think a shipper have to have broker authority to hire a carrier,and why i asked how fast he paid is because he probably just took a fee for a one day quick pay.

    No he took over 7000 out if all our loads this was over a four month period on three trucks

    There was no quick pay available he is an owner operator
