The problem with this line of thinking is the assumption that the typical driver isn't a decent judge of his/her capabilities, or is prone to exceed those capabilities to then point of being a danger to him/herself or to others on the road.
The reasons for hours of service are solid:
(1) reduce and/or eliminate accidents and deaths cause by driver sleep deprivation;
(2) reduce the use of illegal substances (uppers/stimulants) so said drivers can keep driving while exhausted (a CLEAR case of serious stupidity);
(3) reduce employer abuses of drivers (which in most cases led to items 1 and 2) by preventing them from demanding drivers drive while impaired due to sleep deprivation.
Personally, I like my life. I'd rather not have it taken from me by either some hotdog driver who thinks he can drive 48 hours straight without sleep while jacked up on speed, or some company that demands drivers to operate that way in the first place because they value profit over human life.
Regulation comes about when one human or group of humans consistently abused other humans, and the rest of humanity finally eventually realizes the costs of said abuse of human life. Regulation doesn't appear out of thin air: it comes about due to demands of the citizens for protection from abuse. And since humans can't seem to do any right thing without some sort of stick to beat them into line, it ain't going to go away anytime soon.Moving Forward and peterd Thank this. -

Elogs serve the same purpose: the regulate the companies, and prevents them from pushing a driver beyond his capabilities; they also record what the company demands, and afford the driver protection of the law, protecting them from wrongful termination for following the rules.
Conversely, elogs protect the company, by proving the driver was in compliance, or that the driver was not in compliance.
When a company threatens your job, and then threatens to make it impossible for you to work in that industry again, you feel intimidated and trapped. You're stressed and unhappy, and afraid because one wrong move (in your employers' eyes) will land you on the street, unemployed and unemployable because they blackballed you. You lose sleep, your health suffers, and that leads to disastrous consequences. And it can happen in a short period of time. And THAT is a perfect example of being bullied (which, BTW, is illegal--look up "hostile workplace environment).NavigatorWife Thanks this. -
I have an idea!! Let's throw away the HOS, toss the elogs, get rid of paper logs, eliminate safety inspections and regulations, and just let drivers and trucking companies do what they want!! Heck, let's ditch speed limits, traffic lights and signs, and lane stripes while we're at it, because they just get in the way of delivering that load! School crossings??? FAGHEDDABOUDDIT! Them kids can run, who cares if a few get clipped?? And those pesky 4-wheelers, just ram 'em out of the way, they're just road cholesterol.
Wait a second... I think that's how Mexico does things... we're already letting their unregulated uninspected rattledeathtrap trucks into the states, so why not just join them and be like them??
Or, if you just done like US regulations, you can move to Mexico...
