I hear what you're saying but really, is it REASONABLE to say someone was distracted just because they were smoking, taking a drink, or sneezing, or whatever? I don't think that "living as a human being" should/would be deemed "distracted" so long as the person remains in control of the vehicle and wasn't doing anything UNREASONABLE, such as holding a cell phone/text messaging.
In the same vein, just because there was no video of the lady (who was at fault here) doesn't mean that she was not distracted. This is why I think people take it a bit too far with worrying about what the law is going to consider "distracted driving". I've yet to see a case where someone was found guilty of distracted driving for the things you mention. If there are some court cases involving this, I'd sure be interested in seeing it.

gpsman - I normally agree with you, but on this one, I'll respectfully say I believe you are wrong.
The op talks about sleeper facing cameras that cannot be blocked at anytime. He also says they can be triggered by management at any time.
That is waaaay different than having a forward facing camera. Not even the same ballpark. I can record anything I want in public, but I can't record in a persons bedroom without consent. Even if drivers give there consent to get the job, it is so offensive, that paper won't hold up in court when the inevitable lawsuits start to flow.
Sure, I know nobody wants to see an off duty, overweight driver laying on his bed in his tighty whities. But the idea that they can is offensive and an invasion of privacy at the most basic level.OPUS 7 Thanks this. -

Again just playing devils advocate but, when a professional driver is involved in ANY accident they seem to be considered guilty until proven innocent. That's why the scene of the accident is investigated so thoroughly. If investigators find anything wrong with the equipment or have any evidence that the operator was doing something wrong then they automatically get the full brunt of the blame. I dont think they are so meticulous about investigating an accident involving only 4 wheelers...
