NEW ORLEANS - Relatives of three people killed in a Christmas Day crash in 2008 were awarded a multi-million dollar settlement following a decision by a New Orleans Civil District Court jury.
The plaintiffs' attorney says the $90.5 million judgement is against Westernstar Transportation and its owners.
After a Lincoln sedan had a flat tire, the driver was traveling slowly on Interstate 10 in an effort to safely pull over at the next exit. That driver was being followed by the driver of a GMC Yukon, who was trying to help.
That's when a tractor-trailer slammed into the SUV, causing it to hit the sedan and catch fire.
Three passengers died, including a 6-year-old and 3-year-old.
The accident took place shortly after midnight on Interstate 10 in LaPlace on Dec. 25, 2008.
The driver of the tractor-trailer claimed the slow response was due to her fatigue.

I heard the driver had no available hours to be driving and was making a mad rush to get home to her family for the holiday.

Not sure if management was telling the truth on this or deluding themselves

into believing it were true in order to save themselves.

Yes, what you heard is correct. After a jury trial, the families were awarded 90 million! Yes, that is not a misprint. The driver of the truck was charged with vehicular manslaughter. I am not sure how her case is doing. The owners were forced to sell their homes. If any of you don't think this could happen to you....Be careful. You can be jailed if you hurt or kill someone while driving beyond your HOS!!!!

First and foremost you never ever tell law-enforcement that you're fatigued even if you feel that you are... Is the minute you tell him that you're finished
