    Not sure what it is you're not able to grasp? WI is an at will state. Schneider is based out of green bay. If you don't Lind their policy you are free to terminate your employment with them and go elsewhere. If you truly believe any company hires people and then immediately looks for ways to fire them then I pity you. Will be tough to find any happiness in life.

    If they insist on cpap as the way off gaining compliance they probably have their reasons, I would guess lawyers made that choice.

    There may come a time when every truck driver in the United States of America is REQUIRED to take the sleep apnea test, as a condition for obtaining employment or remaining employed as a truck driver, especially as an OTR truck driver.

    Hate to break it to you pal but Schneider would not be issued a ticket if a driver was caught using a cell phone without Bluetooth. The driver using the phone without Bluetooth would be issued the ticket. FTR I didn't do my research on that, just plain ole common sense.

    Absolutely correct, drivers will be issued a citation with a civil penalty of up to $2750, Carriers are also prohibited from requiring or allowing their drivers to text or use a hand-held mobile phone while driving and may be subject to civil penalties up to $11,000.

    So in short SNI's policy is in place to protect them from the 11K civil penalty. However, SNI went a step further than the DOT rule and decided that even having a conversation while driving distracts your brain from processing all the information you see when driving, which leads to distracted driving.

    Now to the OP and the issue of sleep apnea, every employee during either their "safetrac" or "experienced enhancement module" are required to participate in the Sleep Apnea survey. Sorry your results were flagged and you were determined to be at risk, but it is just how it is. The surveys you filled out are not a positive result for sleep apnea, merely an indicator that you might be at risk of having it. The only positive way to determine that you have it or do not have it is to send you for a sleep study. The results from that study will dictate whether or not you need treatment.

    As for SNI's policy requiring you to use a CPAP if you have it, the FMCSA has not issued a rule on treatment for sleep apnea, they have merely issued guidelines. SNI at its sole discretion can, even if the FMCSA issues a rule, require their employees to meet a more stringent requirement. That means that SNI's policy can be more stringent, but not less than a rule. Fighting them on their required form of treatment is not a wise choice, you will not win. They can and will find a driver to replace you in a matter of days.

    In conclusion, if you do not want to have a sleep study you have two options. (1) QUIT. (2) Continue to argue with them and refuse, which will lead to your termination. I should mention that sleep studies have moved from the sleep centers to hotel rooms, only a single device is used and it is attached to your wrist and two fingers. Watch this video. You spend one night in a hotel and the results are read the next day at the OC. It is not really that big of a deal. In the end the choice is yours to make. Also, as long as you participate in Schneider's Health Insurance the cost of the CPAP (if needed) is covered at 100%.

    Most trucks you can override the on guard when it craps out by turning the cruise on and off four times. The truck will cruise like normal once you do that, minus on guard of course. Never had my on guard apply the brakes for no reason but I too have heard many stories of it doing this, mainly the 1st gen ones.

Motor carriers are also prohibited from requiring or allowing their drivers to text or use a hand-held mobile phone while driving and may be subject to civil penalties up to $11,000. Violations will impact SMS results. Texting and calling on a hand-held phone carry the maximum violation severity weighting in SMS!

    You seem a little confused. I think you should re-read that(it was posted already, don't know why you posted it again) and try to comprehend what you are reading.

    You will notice the wording if you concentrate. If a driver is caught he will be fined, the carrier will ONLY be fined if they REQUIRE or ALLOW the driver to do this. SNI clearly does not allow it, so they would not be fined.
