    I was using that as a means of an example of their company policy where they don't check for "compliance" but they turn around and have to claim that they have to check for compliance with a cpap machine cause it's "company policy".

    It is company policy. Can they set their own policy as long as it doesn't interfere with FMCSA?

    You seem to think you should be able to set policy. If SNI wants to drug test their drivers every week and make that policy, they have every right to do so.

    It is simple really. If you don't like their company policy, go find a company that you like better.

    Yeah, that's what we need in this country, more lawsuits.

    Seriously, please find another company to work for. You're probably a nice guy but if you'll waste this much time arguing about a company policy on the internets, You have way too much attitude. And with all your medical conditions, you'll be an insurance liability.

    But that's my point: for every fat person that has it, there is at least one skinny person who has it too.

    My step-grandfather had it in spades: he sounded like someone set off an M80 in his mouth every time it happened... over, and over, and over, and over. He was 6'2", 230lbs, and at the time he had it (mid-late 70's), he wasn't even remotely overweight, he just a BIG guy.

    Remember my earlier post, and the post of the lady who did a thesis on apnea: it is PURELY a physiological phenomena that occurs as we get older, period. It's not a disease, it's not a fad: but it is real.

    As for being "self-inflicted": not all fat people can help being fat. Human physiology is a complex thing, based on well over a hundred thousand years of evolution; and we are still learning it. Many "fat" people are healthy as horses, strong as them too, and have no real problems; others, their bodies are just betraying them, and they can't lose weight to save their necks, no matter how hard they try. And that is a legitimate "condition" as well, one that science hasn't yet solved.

    Bottom line is: it has to be evaluated on a case-by-case basis, and the patient's rights must be preserved during the process, no matter who initiated it.

    I was examined by Concentra prior to heading to Indy to begin my training with Schneider. The nurse said because of my weight, neck size and the fact that I can fall asleep in front of the TV I may have a sleeping disorder. She issued me a card good for 4 months and said I should attend a sleep study and wasted no time in handing me a flyer of a local group that performs this study.

    The study was about 800 dollars and would be out of pocket. She ended my visit when she saw that I was getting angry. " I am not being mean, I am just doing my job," was her reply.

    That's one of the points I've been trying to make. If and when I'm "marked" with having this screwball condition, it's my legal right to chose the treatment that best fits my needs. SNI has no legal grounds to state what my medical options are by simply quoting "company policy". If I wish to use something else that's been FDA approved, that is my option between my self and the medical provider.

    Some people just don't get it. If you have this condition, why wouldn't you want treatment? It is very unhealthy and can shorten your life worse than smoking. It certainly could contribute to an accident.

    Denying it will not make it go away. A sleep study will determine if you are affected. Anything else is like that river in Africa. :)

    He's still hung up on the idea that his employer is somehow violating his "rights" by having a policy he doesn't like. Seems to lack the testicular fortitude to put his money where his mouth is and just go get a job where people are willing to overlook his health.
