Today I got an unsolicited email from a recruiter about a local driving job in my hometown. I am not really looking to change jobs, as I'm happy where I'm at. But, I called this woman, just out of curiosity.
The job is a P&D job for an ltl carrier. The pay is $14.40 per hour and she said I could expect between 45-60 hours per week. I said that sounded pretty good if I could rely on close to 20 hours of overtime per week. She said no overtime, it was all paid straight time. It was my understanding that all hourly positions had to pay time and a half for all hours over 40. But she said that wasn't the case with driving jobs, as there is a federal exemption from paying overtime. Doesn't the exemption only cover drivers paid by the mile?
If that is the case, this job would be more work for less money than my current OTR job. I'm home every weekend now (for the whole weekend, not just 34 hrs), so if I had to work 8 am til 8 pm mon-fri, I really wouldn't even have more time off. Yeah I'd sleep in my bed, but I wouldn't get to spend any more quality time with my two young kids during the week. Seems like a horrible deal without overtime.
So my question is, what's the rule on overtime for hourly driving jobs?

Unfortunately drivers are exempt from overtime. Work is work and I think it's an unfair law especially since drivers are pushed to 70 hours a week. But we have to keep them store prices down.

All I can say is.... I couldnt do this job I'm doing if there WASNT any overtime

14.40 an hour at a LTL company? Your joking right? What was the company? Most of the major LTL companies pay their p&d guys about 18-25 an hour and most also pay overtime too. If you're working for less than that I would hope that you really enjoy the job.

Most LTL's pay overtime after 8 hours each day...the good ones anyhow , if they're calling you..then run , don't walk away.

I talked to a guy who used to work for the company i work for now, it's local hourly, he said he saved all his check statements and when he left, he filed to the labor board for unpaid overtime and had it paid to him, bought a truck with it, not sure if it's true but I'm saving all my statements anyways

Hi 8th note, in all my years of driving (over 35) I only remember 1 job where I got time and a half after 40, and that was a union job, and they did their darndest to make sure we never went over 40 hrs. It's one of the wonderful loopholes of our industry, not to pay time and a half. Maybe that's decided by people who don't consider driving real work, I mean, you just sit there and drive, how hard is that?( believe me, I've had people tell me that!) And mileage and % are even a bigger joke, as some days, you'll be lucky to make minimum wage. If all us drivers would be unified and stand up to this, perhaps we could make a change, but I don't see it happening. I did the local scene (at straight time) most of my life, because being with my family and enjoying my hobbies was worth it, but usually local drivers get the shaft.( come to think of it, all drivers get the shaft)
