passenger policy

    The company I'm with now does not allow passengers. It's not such a big deal, since I'm home nights and weekends. But I run NYC and / or Philly 3-5 times per week, and it would be nice to bring the wife along for a lunch date in the city every so often.

    I know that there was an accident a few years before I got into the trucking where the driver rolled the truck in the town where I lived. He was ticketed for having a passenger without documentation. I am not sure of the company.

    I personally do not travel with a passenger and never will. So, it makes no difference.

    Our company had a driver ticketed for it and I do not personally know the guy.

    My friend wanted to take his wife on a trip and they told him they had to provide the company with the information and the signed document prior. Our company countersigned it and he was required to keep it in the truck.

    Right. Law enforcement will write citations to force payment by insurance companies for injuries and property damage. Once payment is made, the charges are dropped. In that case, there was probably no documentation on file whatsoever. I don't see a citation being issued for an 'unauthorized passenger' just for the sake of the passenger being there...

    And that is in line with the guidance that I linked. It is the company's option as to whether a copy is kept with the driver or not.

    But the regulations say nothing about a requirement for the documentation to physically be present in the truck or with the driver. That's my point. If there's no specifically stated requirement for the documentation to be present with the driver, then the driver can't be cited for not having it. If law enforcement cannot get verification that the document is properly filed with the company, then they still can't cite the driver. Innocent until proven guilty.
