    I agree that the carrier bearing is not the problem. But a judge won't know that. A law suit would require some sort of expert to testify against the shop's expert and then it's up to whomever the judge wants to believe. Contrary to what we saw in My Cousin Vinny, experts that are recognized by the court usually cost money.

    I have retained an accident reconstruction "expert" in a criminal case. So far he has billed me $5,000 and I've done most of the work. It's going to be over $10,000 by the time he travels to the court and testifies. That's just for the expert....counting legal fees and court costs my bill will be over $20,000.

    Just sayin'.

    That stuff aside, would replacing the carrier bearing when a new shop puts in the transmission be able to be used in a court case to show it was NOT bad w/o the expense of a noted expert?

    You raise a good point rank, however this is civil which is another ballgame.

    The company knows they are in the wrong and have a weak case. If MrBeast and his attorney can convince them he is willing to spend much more than the amount in question to battle them in court, they will settle. This isn't that big of a case; a threatening letter by an attorney may even be enough to get their attention.

    Hope it gets settled quick for you MrBeast.

    no its not. you have evidence of criminal and civil wrong doing. they can make it up to you or you can go to the police and court and then will be forced to make it up to you.

    its called settling out of court.

    I would agree with getting paid for what he spent at their shop, lost wages, attorney and any other costs. Enough for a new truck? I agree, that's blackmail. Besides, with a nice W900 that I would guess is pre emission and def, why the hell would he want a new truck?
