In regards to off duty vs sleeper talked to my companies safety man. Said to use sleeper for everything except hometime or when no where near truck. Had a friend that had been using them interchangeably and she got cited last week by dot

 

And yet my safety department has told me it's ok to log off duty even in the sleeper. Which I guess means DOT can interpret the rule any way they want. Go figure

 

If you're off duty log it off duty. if you're in the sleeper log it sleeper berth. Simple. After 10 hours of either, or in combination, you have had a legal 10 hr break. Simple. Don't confuse split sleeper berth regulations with those defining the 10 hour break. Don't confuse team driving HOS regulations with those defining a legal 10 hour break for a solo driver. Don't confuse logging resting in the cab as off duty with being part of a legal 10 hr break unless it is.

 

just to to be clear. I'm not arguing for the sake of arguing. For me it's simply forgetting the majority of the time of changing the elog from off duty to sleeper. Sure I can edit it but if it's legal I just leave it as is....also if I take an extended break or reset and put myself in the sleeper I get a form and manner violation after 15 consecutive hours in the sleeper. That was when safety told me it's no problem logging my 10 hr break as off duty.

For the record this was never a problem when on paper.

 

The operating proclivities of different Elog systems and company policies are not necessarily the same as FMCSA regulations. Drivers need to know the difference.

Black helicopters do not swoop down and demand motel receipts, but if you log it different than you actually did it, you set up a potential pissing contest: one you won't win.

 

I dont know . I for some reason think I remember reading somewhere , but I have been known to be wrong before.

I always just use sleeper when I am in the truck , and use off duty if say I am out for food , shower, home , or (inside a shipper or receiver) shhhh on that last part. .
