Took over a load for another carrier, now he refuses to pay.

    I got a phone call from another carrier who had a small enclosed trailer needing moved. When I arrived to pick it up it was more than twice the size described. He quickly agreed to the additional charges. Since I was not delivering to him I was not able to collect on delivery. He was going to mail a check. However he has now made it obvious he is not planning on paying at all. What's my best course of action?

    Cert. letter to get the collection of money moving, keep copy of everything for a trip to small claims judge.

    Baha is pretty much right on. Sorry for that. Still, when you got there and the trailer was twice the size, didn't some alarms go off?

    Hope you have a contract and he has broker authority,,if so file against his bond,,if not go and file in small claims,getting a collection agency is like peeing in the wind,

    Yes, it was a concern so I called him right away. He did a great acting job I suppose when he explained he had no idea and promised to pay the additional charges which we agreed on right then. Once I delivered it, he said he was putting the check in the mail and still did not sound fishy. Now he won't answer calls, respond to emails, or letters. I have sent him a bill, then a past due bill after 30 days and still not a word out of him. Been a total of about 2 months now. It's not enough to break me or anything, just a matter of principle. I work my butt off to go above and beyond and I was MORE than fair in my additional charges. Infact, the receiver gave me a tip on delivery and I even took that off what I billed this guy. Bad news is he is not a broker and only has carrier DOT and MC

    well tell everyone who he is,,file a complaint with the dot and sue his butt right away in your local small claims court,,most of all tell us who the scum bag is ,,pass out his phone number so we can all harass him.

    Simply call the fmcsa and explain he was brokering without a brokers license. Stiff fine!!
