I'd run away from that truck. I'm the type of driver that "what if it does break"
Of course we all hope nothing will happen but WHAT IF IT DOES? The first thing that will happen is you'll never be able to get a LEO to say the brakes were ok NEVER. The DOT will inspect your truck like it just came off the assembly line. They will see those brakes and they will automatically state that the out of service brakes had some fault. to the accidents Now if they find nothing else then your brakes did it. That is 9 times out of 10 anyway.
Then you'll get to see some frenzy feeding going on with the lawyers. You're in a bind, your company wants to get rid of you, or if not with a company then you're all out there by yourself with the onwer. And I would bet he'd say he told you to gey it fix. He sure doesn't want to go to jail.
Believe me, I don't know what would happen all I'm saying is whay could happen. I'd sure protect myself better. I have seen where people go after deep pockets and any little thing they find is a plus on there side.
I'm lookinh for a case that happened many years ago up around Seattle where this trailer came away from the pintal hook while the driver was getting off the freeway. The trailer flipped and slid down onto the road. Then right at that moment a yound girl drove through the gasoline and her car set it on fire. The case lasted for years and IIRC the pintal hook was to blame at no drivers error. I read the case once and should have kept it because it's a great training document to show drivers that they will go after someone for money no matter how long it takes.
