Can DOT Impound a truck when placed OOS?

Why was he running a tire that low of tread. Doesn't the reg state 3 separate areas around the tread 2/32 or below to be oos?

There's a state trooper in Michigan that does the same thing. OOIDA is suing over it to. The story about it is in Land Line magazine.

 

I'd be making some phone calls to see if what China said is getting to be a new practice. and if it's legal.

And since someone is going to bring it up, this is the CVSA OOS criteria, not the legal tread depth you need to have on your tires. You can get written up on an inspection for less than 4/32 on steers and less than 2/32 anywhere else, but you are not out of service until your tires wear to what is above.

 

Being placed OOS for a bad tire is one thing. The vehicle is only OOS until the OOS violation is repaired. CVSA and FMCSA do not require impounding. Here at the scales, the vehicle is not permitted to proceed until repaired, or it may be towed for repair. Driver option.

Being impounded is a completely different thing. There must be other compelling circumstances to warrant a vehicle be "compounded" or impounded. There may be more to this story, there usually is.

 

Not a new practice. Crooked cops have been pulling this crap for years.

 

The Ontario scale near Sarnia does sonething like this.

They impound the truck until a mechanic comes and repairs it.

After 24 hours w/ no mechanic they remove the license plates and send them back to the respective states.

Never had that happen but that threat gets most fleet owners to pony up whatever the local wrench wants to get the truck repaired.

 

That is a provision of MAP 21 regulations that went into affect last October 2013
