    Another update....didn't pan out with the lawyer. He seemed pretty clueless about CDL points and after he spoke with the district attorney, the deal was pretty much the same as if he didn't have a lawyer. My husband got rid of his lawyer, went to court, took the charge and a $210 fine.

    Well, it is what it is. Too bad about the lawyer. I'm guessing he still charged the $ 350 bucks.:biggrin_25510: Has he had any repercussion with his company over this?

    So you're saying he was running a hazmat load without knowledge that it was a hazmat load?

    There were probably different placards required than what was on the trailer.I've had cases were a load had 3 or 4 different placards depending on the freight.Sometimes a placard that says danger will take the place of multiple placards.

    No I'm saying no one actually took the time to go over the chart to make sure they had it right. He must have had a mixed load and those can get tricky. She never said what placards he was displaying.

    OK, let's post the original post again.

    Now, as she stated in another post, she is not making excuses for him, just explaining the situation. So yeah, he screwed up, and there really is no way you can excuse that. OTOH, the load was given to him after it had been picked up by one driver and given to another driver, so he is the third driver in line to get the load.

    Sure, he should have checked his paperwork and made sure he had the proper placards. He made a mistake, and I'm betting he will never make that mistake again.

    It can be tricky to figure out what is and what isn't hazmat. It's supposed to be clearly marked, but if you are a new driver and not sure what you are looking at it is easy to miss. Since this was handled by 2 previous drivers and they didn't catch it, I'm not going to be too quick to cast stones. My limited experience has been that the shipper not only marks the paperwork, but also includes the proper MSDS paperwork and placards.
