I picked up strawberry load from Wattsonville CA. Broker is TQL team load going to Bronx 34 degree continous we are team ,We got there earlier than delivery time I have no reefer or temperature problem , I had digital temp. recorder on load ,They gave me door and didn't let me to watch unloading send me in cab they took 2 pallet out and told me to close the door and wait after 2 hours latter inspector came and i stayed in cab ,they finished unloading ,I got BOL signed and says some soft spot on.. I booked another reefer load from TQL going to Los Angeles meanwhile TQL broker called me, said there is temperature issue on strawberries and I may have potential claim anyway ,after I finished second reefer load without issue, I picked another load from salinas CA. 34 degree reefer load ,similar to first strawberry load delivered also no problem , after couple week later when I called TQL for payments ,They said there is claim on first strawberry load second load clean but claim is high until investigation over they will keep both freight pay..I told TQL my part of story ,went to termo king down loaded those days ,got report shows my reefer is good..I haven't received my pay yet.They send claim to my reefer broke down insurance ..My question is I know strawberry is good they sold it and my reefer is in good conditions ,inspector he didn't even say any think to me just looked at me..I just want to fight because ,we worked hard ,honestly on time delivered the load , any suggestion or law firm ,or experience helps Thank you

What does the USDA report say?

Go to the Produce Blue Book and look up the receiver and shipper's record. If they have a history of these type claims, it will show. I would never load a high dollar produce load without checking up on the shipper and receiver's listing.
You are entitled to a copy of the USDA report, and a copy of all sales made from the damaged (?) product. Good luck, hope you prevail.gunnermike Thanks this. -
I didn't get USDA report ,Where do I get that ,probably is negative because Inspector is their buddies , all I know is I don't have tempereture issue

Get your cargo insurance involved. They'll get the USDA report. Soft spots can be a quality issue or can be blamed on rough treatment by the truck.

If your a member of OOIDA have them file against TQL's bond for payment.

you get loaded, and you sign the bills. you are IMMEDIATELY responsible for the load.
you get unloaded, receiver signs your copy. your are IMMEDIATELY releived of all responsibility for the load. and if they make no comments. your basically done with the load.
is that NOT the way it works in the reefer business. cuz, man, there sure are a lot of complaints about the reefer business. really sounds like someone not wanting to pay for a load. and in this guys case. TWO loads.
i can't beleive someone could come back sometime in the future to bite you. when the load was delivered and signed for.
i had load of onions once, that had a comment to something about inspector approval. but the bills were signed. and i never heard a word afterwards.OldHasBeen and gunnermike Thank this.
