Sleeping setup in your pickup.

    Are you hauling motor homes? If so the DO guy can assume you legay were off duty sleeping there. You got off easy, but DOT can legaly request info about where you were off duty in regaurds to sleeping. They can even put you out of service if you admit to getting no sleep. There is a reason that there is a sleeper birth line on the logs. Otherwise we would all just log off duty. Just because you got away with it, doesn't mean you are right.

    show me that law....where are you getting your info? You can legaly log off duty around the truck, but if that off duty time does not considet of time in sleeper or time at home/trailer/hotel, then you ar still in violation. You could always log off duty while chilling out, but you always need some time elseware if logging off duty. If you disagree, show me the code that says im wrong

    The sleeper berth line is there for company drivers, and the fact that it was nessecary before the changes...I have been around all the bases, hired attorneys, and settled all of this the legal way, and no, once you say you were off duty, all the math adds up, and you are legally operating, they can not make you provide proof you stayed in a hotel or at a friends...but your right, i just started driving 18 years ago, and had my run ins with this issue myself many times and dwelled Ito the legality not just "got lucky"...I always ask when questionable...but your right, obviously, and I'll leave it at that...anyone who takes worth out of my words please do so, if you don't, then don't.     Now your trying to tell me that there is a legal difference between company drivers and owner ops when it comes to logging sleeper birth time? The only difference is logging requirements of pre and post trips of single truck companies.

    Clearly DOT made restrictions for sleeper birth size. No matter how you log, if you dont meet those requirements you asking for trouble. Changing the way you log isn't changing the fact that you have an illegal sleeper compartment int he truck. Loggin off duty so you can sleep in your small sleeper is a loop hole at best. If a DOT officer wants to be a dick, he will give you a log violation.

    No, I am telling you that some companies REQUIRE you log sleeper berth...I am my own boss so therefore I don't require it.

    This link will provide you the regulations regarding HOS, and in that it states everything you need to know. The sleeper berth provision clearly states 10 hours of non driving to consist in whole or part sleeper berth AND/OR off duty time. Do your research before you tell me I'm wrong. Everything is stated on FMCSA Website, why don't YOU show ME where it states off duty for 10 hours does not constitute legal HOS operation, and receipts and proof of sleep is required.

    I am legally operating as of July 1, 2014 to be off duty IN or ON my truck, as long as I am NOT driving...you need to brush up on your regs before trolling

    Loop hole or not, I am legal...and so is everyone else who operates within the clearly states regulations, with no clear violations....law revolves around grey area, and I am breaking none of the black and white
