Ummmm, baloney. You can be on duty/not driving as far over 14 as you need to be. You just can't drive after the 14th hr. So it seems, if your story is true, that neither you, your driver, or that officer know the law. Yes, a D.O.T. officer can legally wake you up, and have you go back on duty for an inspection. But there would be no violation unless you didn't take a proper length break after the inspection was over before going back on duty the next time. Load might be late, and it may be a pain in the butt to have to restart your 10 break, but nothing illegal happened.Tonythetruckerdude Thanks this.

The police have to have probable cause, like a visible gun or drugs laying around. If you are clean and your truck is clean, the DOT will leave you alone. I'm not saying that they will search you just because you and your truck are dirty, but if you are unlucky enough to be stopped, being clean and professional is always a better bet than being a dirty scumbag.
You can find numerous videos on the net where people are being asked by the police to have their vehicle searched. They say no and unless the police have probable cause they can't do anything but let you go. Keep an accurate log book or EOBR, make sure your lights work, brakes are in adjustment, tires are good, and your load isn't falling off the trailer the DOT will move on to the next guy.
There is a lot of wisdom in having a good rapport with officials. As far as the 4th amendment, well chances are if you are stopped it will be your word vs. the officer, so keep your cool, be smart about the answers you give the DOT and follow the rules.Mudguppy, MrEd and skyviper73 Thank this. -
how many times does this question have to be asked? anyway, sure say no to the DOT man, it's your right. it's also his right to write you separate tickets for everything wrong he can find. if you want to keep them outa your bunk, get a dog. everytime i tell them or show them i have one, any inclination of having to hassle with it is gone.
as for the 4th amendment, ya need to learn, as a truck driver typically you don't have any rights. for example, most 4 wheelers have to do something wrong to get pulled over... you as a professional driver don't.

i've been told that they WILL break a window or something if you refuse to answer the door, because something could be seriously wrong with you (dead, mostly) at that point its a threat to public saftey
