There was a weigh station where the DOT officer asked for my logbook, so I removed the seatbelt to get it from dashboard then the officer instructed to move the truck up 20ft. When I exited the vehicle the officer writes a ticket for operating a cmv while moving without a seatbelt, should I fight this in court?

He probably runs this scam all day long. Learn from it, try and have a lawyer throw it out in court, and move forward.

Anytime you're in the drivers seat, always ware a seat belt. Unless required to exit the vehicle.

This is unbelievable. Exactly the type of thing I fear most about DOT cops. Man I'm sorry this happened to you. I'd definitely hire an attorney to take care of the ticket. Then I'd probably concoct some story in a letter to his supervisor that will go in Barney Fifes permanent file. Give him a taste of his own medicine. What baloney!

Next time ask if you can pay for the ticket on the spot. That type of cop would probably pocket $200 & toss your ticket away...

My question to you would be,Did you operate the CMV without your seatbelt on ?..That is all the judge is gonna consider,of course you can fight any ticket..but there may be NO reason ever to not have that belt on ..
