overweight issue who it's at fault?

    Picking up a beer load with a reefer is going to be asking for it. The guy that loaded the trailer loaded you like he would have a dry van but should have shorted a pallet to account for the heavier trailer.

    33 might be a little low.....you might try something like oh...i dunno, maybe 100%. Seems about right. If the shipper had a scale there why didnt you use it if, after you asked numerous times what the weight was and they would not tell you, you were so concerned with how much it weighed in the first place. Did you scale the truck/trailer when you entered the facility? We all make mistakes and there is a learning curve.

    Sounds like you were concerned it would be overweight and you didn't want to deal with it until after you got some rest. Gotta put that one on you.

    I have my doubts about that, since it's nonsensical... but then your next question should be, "Where would you like me to drop this trailer?"

    i don't see how you all can possibly blame 100% the driver. after all, he said his 14 expired. he shouldn't have left the facility in the first place. but we all know they don't let you stay till your legal to drive.

    i personally, wouldn't have left. if they can't give you your weights. that's your sign right there your too heavy. shippers have every excuse in the book to load you heavy and not deal with it. they hope the driver will just roll as some do. and they get really upset when you come back in the morning. as you've just experienced.

    pulling a flatbed, those shippers work bankers hours. it's not uncommon to pick up wood (for instance) but your held up there untill the last truck. they tell you the load is being built. and while your waiting there. watching other trucks slowly get loaded. at 15 minutes to close. they hurrydly load you up. and go home. and they're usually out in the middle of nowhere. 200 miles from the closest TS scales.

    Take all of it. Don't let them screw you over like that if you can use their scale. Saves you $10.50 and having to go out of your way to find a CAT scale.

    There's a lot here that just does not add up, What time did you arrive at the shipper. Your not on the dock, or you would have know you were over by simply counting pallets, and most distributor don't want you there at least not where I've been to. Why are you on duty, your certainly not driving or load. You state that your were here longer than 14 hours, then you should have been ready to roll with 10 off. If you need permission ask your dispatcher or OO if you can have a off duty card giving you permission to go off duty.

    No weight on the BOL, legally required I believe.
    Anhauser and Coors insist your legal before you even roll off there properties. You say they had a scale but would not tell you the weight, then allowed you to leave 2000 over, then later refused to adjust the load. None of this makes sense because if yo were to get it to an accident it would make them at least partially liable, maybe fully liable depending on when the accident took place. Story just does not hold water.

    It is always the drivers fault if he rolls with a heavy load, and beer is not loaded in the middle of Sherwood Forest, well maybe Shine but that's a new thread...

    I'm not lying. I started my day at about 5 am loaded, went and drop that load. Then I went to the QT close to Miller sat there for about 2 hours, fuel and went to Miller. Got there about an hour before appointment at about maybe 5 pm, left at around 10 pm and went to bed.

    Miller does have a scale in and out, but it will not display your weight and they will also not tell you the weight, but they said they wouldn't let you ho overweight. So with that info I said to myself, if I'm not over 80 I went back to the QT, there was 1 parking spot only, if I scaled the truck it wouldn't be available by the time I was done, so I decided to park and scale it first thing in the morning, on the premises that I would only need to move the tandem. I scale it and I was 81, actually it was like 80.900 or so. Went back to Miller to get it reworked and they refused to do it, saying that they didn't got enough people to do it. My dispatch told me to hold till Monday morning and get it reworked. Miller refused to rework it again, and dispatch gave directions to drop the load at a nearby warehouse.

    Is it my fault for not scaling it right away yes. Now Miller could have done a better job scaling my truck they said I was not overweight when I left, and they could also had it fix on Saturday or Monday when I went back. O/O could have contracted a lighter load too. As you can imagine is hard to tell every detail of what happened typing on a smartphone but I have given the critical info.

    That day I worked 17 hrs, so I did need some sleep too unfortunately I'm human.

    Seems awfully suspicious too me.
    By chance did you get fuel after you loaded?

    I just wrote that I fuel at the QT before going to Miller.
