Who is liable?

    No I said that the equipment is certified by the DOT. Read it again. If you move a piece of equipment that is unsafe or likely to be unsafe YOU are the one that is responsible. A wagon went over the side of a mountain?. .I wasn't there but in mountains slow is the to go.
    But than again I was not there so I can't lay blame. Now go research the securement requirements for THAT kind of equipment and the product hauled in it.
    You have been answered several times based on your requests and questions. I think most of us have said the same thing .

    There is no DOT certification on a valley bin or gondola.

    You are not reading what I wrote.

    It appears to be a losing propositon to try to explain the difference between industry standards, working conditions and road safety when people are stuck trying to tell you that it is the truck drivers fault.

    I have hauled grapes for 10 years during the harvest. I don't need to read some book on what industry standard is, because, wait for it, industry standard is set the bin on the deck, insert two leverage pins and roll to the crusher.

    What everyone is saying. Off the road is one thing, but as soon as the driver takes the load onto a public road, the driver is responsible for the load. Anything happens it will be upon the driver. Why not toss a strap across the bin or is this cutting into your time to get the load to the crusher? So the family you dump the load on and they careen off the road and flip over is not worth the extra time to make sure your load is secured before entering a public road?
