How is this situation logged?

    This is legal and I use to do it whe I casuled for other trucking companies. You fill out previous 7 day work hours then log the rest. Just like a brand new employee. You must have a new employee fill out the form. I still do this with my business as a full time Police Officer I can only work 20 hours in my truck (perfect world) if I run local I use time sheet if I go out of 100 air mile I run a log. If I was unable to drive my truck due to going to court day time training etc. when I go back to driving I fill out previous 7 day work record then use time sheet or log witch ever is required. When I got my authority Dot had zero problem wit this.She advised this the best practice for my company. As long as time is accounted for they are happy.

    I now use the big road log book app on my phone and I use the local feature and have the app keep track of all my hours for me so it does not get confusing and I screw up and get fined.

    When he is in the office he is of course "working" for the company and is compensated for that work. He usually goes out for 3 or 4 days a half dozen times per year.
    By in the office I mean not driving. Might be taking calls, turning wrenches, doing paperwork, visiting clients, going to tradeshows, shopping for trucks, hiring/firing drivers...you get the idea. No he doesn't punch a clock or even keep track of his time. No set schedule, and yes he might work right up to the time he gets ready to head out. Sometimes trucks are on the yard, sometimes he flies out to pick up mid route. Yes I know the implications of all that but I am looking for something concrete to put in front of him that he will respect other than "just my opinion". Sorry I can't IM directly - don't have enough posts to allow that.

    I agree with this ^^^ and.....

    This ^^^ as a correction.

    He only needs to log his previous 7 days plus his days as a driver. To be honest in his logging, he does need to show himself on duty, not driving, for the time he was working in the office (like 8 - 5 etc) during the previous 7 days. He can not (honestly) show himself off duty or off etc.

    If he is going to drive a commercial vehicle he is suppose to have a log showing his previous working hours for the past seven days. He is getting by logging off-duty for those past seven days because he is not punching a clock or logging into something to show his time worked. Yes, he probably is fine doing this as long as he keeps going along fine and doesn't ever have a serious accident where everything is scrutinized.

    The thing is, this is not a perfect world and he could hit and kill someone out on the road for any number of reasons fatigued, not paying atterntion, etc, well if it gets investigated deep enough and it turns out somehow through the investigation he has lied on his logs then I am sure he will get reamed. I'm sure others will chime in as well that may explain it more or better.

    I think something that makes a major difference hear is the he is the owner of the company. Not just an employee. My money says he gets a flat salary every pay period. If he drives, is in the office, or any where else doing what ever he wants he gets the same pay check every pay period. My money also says since he is the company owner not just O/OP with one or two trucks what he is doing it properly as is. As I said previously, since he signs your check and told you that is how he is going to do it I would just say yes sir thank you very much have a Blessed Day.

    I see what everyone is saying and yes to be perfectly correct he should log the past 7 days office time as on duty not driving. However, most who own trucks will tell you that if they logged every hour they spent doing trucking related task as on "duty not driving" then they would constantly be out of hours. I have 2 offices, my truck and my home office. Do you really think that I log my time spent in my home office as on duty not driving?

    How many of us, when we're off duty, do truck related things ? Like wash the truck or change the oil on a Saturday afternoon in your driveway ? Even talking with dispatch on your cell phone while supposedly doing your 10 off ? I'd say the truck company owner is OK doing it the way he does it, because his primary job is in the office. He only gets behind the wheel if absolutely necessary, to cover a sick driver etc. If a mechanic (CDL qualified) takes your truck for a test drive after doing repairs, does he fill out a log book for that 30 min drive ? I don't think so. How about the salesman who you go with and he drives the truck off the lot and around the corner then lets you drive ?

    Maybe so, but the Government is right 100% of the time. ( in their own eyes )
