im now classified as a driver that goes out of a 100 mile radius, i have a
bid run mon-fri that is 7.5 hours drive time and .5 on duty not driving time
i have asked a couple guys at work and they were not able to explain this
question so that i could understand it being that im somewhat new to
driving and i didnt know the old HOS rules(they said it would fall under that)
i know i could run extra one day on the weekend, but could i run both? 7
days of actually driving being that im only driving 7.5 hours mon-fri but
sat and sun would most likely max out my 11.
a week might be like this
mon tues wen thur fri sat sun
7.5 7.5 7.5 7.5 7.5 11 11 only driving time/not on duty not

You can as long as you don't exceed 70 hours in 8 days. When you add all the hours up I came up with 63 hours in 7 days. That's legal. IF you drive another 7.5 hours on Mon. that would put you at 71 hours in 8 days. Only 1 hour over the legal limit. I doubt you'll have a problem exceeding just 1 hour over the limit. Hope this helps.

Driving time and on duty not driving count on your hours of service.
If you did drive like you indicated over seven days you would be just under the 70 hour rule, that is including the 30 minutes on duty time. You would be legel there.
One thing I am not clear on is the change in the 34 hour break, whether if it was manditory or not, but with the way it had been you can continue with the schedule with no problem. -
well i didnt include the on duty not driving time on sat and sun, so thats
where i could have some problems if i dont keep an eye on it
so at 8 days you start over fresh with 0 hours? -
You'll need to take the 34 hour break befor the hours reset.

This is how I understand things to work, any time you work 70 hours in 8 days you have to do a 34 hour restart. You do not get new hours on the 8th day, you get a new 70 on the 9th day.
EX:....on your 8th day you work 9 hours on days 1-7 you worked a total of 60 hours, you then have 69 hours in 8 days, you dont have to do a restart BUT...you must take into consideration that if you get stopped on day 5 of the next time cycle the DOT will count back 8 days and THAT total can not be more than 70, its a running 8 days.
IF you work 70 hours in 7days you have to do a restart, anytime your work hours clock hits 70 you have to do a restart of 34 hours.
I know these things cuz I keep track here at home of what dh is doing on the road and keep him out of hotwater with log book errors/violations at work,,,I am his saftey net.

going by your example:
MON TUE WED THU FRI SAT SUN
7.5 7.5 7.5 7.5 7.5 11 11
that's 59.5 hrs over 7 days.
Going from that, I'm inferring this is also true:
SUN MON TUE WED THU FRI SAT SUN
11 7.5 7.5 7.5 7.5 7.5 11 11
That puts you at 70.5 hrs over eight days. You're in violation. The eight days or 70 hrs don't start on a Monday, a Tuesday, or freaky Friday, they start working backwards eight days from when a DOT officer asks to look at your log book. If it comes to that.
Your reset won't start till you've shut down for 34 hours STRAIGHT!
That means if you shut down at midnight Sat night/Sun morning, you don't have a fresh 70 hrs till 10:00am Mon morning.
As long as you don't exceed 70 hours over 8 days, you don't HAVE to shut down for 34 hours.

I've read this thread twice and I'm still confused.
If it is a running total over eight days, that could mean that time adds to and subtracts from based on where it is in the running count.
Next, I thought that a driver was denied the reset option as a penalty for going over the 70 hours in eight days. But johnybravo said that a reset was the only way to get back into compliance.
So, is a reset the only way, or can hours be recovered until back inside the 70 hr limit? (At which the "no reset" penalty would be lifted).
For example, using the 70.5 hrs mentioned above, can a driver recover the hours from day nine (counting back) less the overage?
I.e.
Duty over eight days = 70.5 hrs
Counting back, day nine = 8.5 hrs
Would that = 8 hrs available for day ten without a reset?
Or is that totally wrong? -
okay guys let me put my 2 cents in here, i'm just about positive,you can run your hrs the old way and run up 70 hrs in7 days and need to take the 8th offand make sure you have 10 hrs off to gain back whatever you had on the 1st day going back to your 7th,you can gain your hrs back a little at a time this way,the 34 rule was made for guys running m=f etc or like that,then after their weekend or next day and a half 34 hrs they start out with 0 again. i don't believe you have to take the 34 hrs off after 70,you can gain back from day 1 of the 7th,whatever it is culd be 1o,4 or whatever,then stop for 24hrs just like you would on the old rules. i hope i helped you a little bit.
