Hello Everybody.
So last night on 12/31/2014 around 3Am i got in a small crash due to bad weather here in Texas. I was on I-20 East Bound. The weather was freezing cold and some ice on the ground. As i was driving, I was slowing down due to a stopped traffic ahead of me. I was at a slow speed somewhere 30mph. I gently applied the brakes and all of a sudden the truck started to fish tail. I was on the Left Lane since the right lane was trying to merge to the left lane due to some emergency stop on the right lane. Anyway I thought i was going to Jacknife so i let go of the brakes and it straightened up. However, the trailer had already slid to the right lane while the tractor was on the left lane. After i finally came to a stop, a gentleman came and told me i side swept his pick up truck when my trailer swung to the right side in which he was in. I took out some of his left taillight, and some scratches on the side. No major damage. I agreed that the trailer swung to the right side though i didnt hear it hit his pick up truck. We exchanged insurance and personal infor because the police could not make it due to high traffic backed up.( There were so many big rig and 4 wheeler accidents around that area)
Anyways after the traffic started moving we came to a cop that was directing traffic and told him the situation. He told us to leave if we had already exchanged personal infor. He gave each of us a blue form to fill in the accident report and mail it to an address. No ticket No Nothing.I called my company and i confirmed to them that there were no injuries to the involved parties and that neither of the car had to be towed. they sent an insurance agent to come and interview me on what happened and took some pics of the No damaged trailer.
My Question is
1. Since No one got a ticket from the Cop, do i get some points or accident in my MVR after mailing back the accident report?
2. Will the cops issue a ticket when they get the reports from both of us?
3. Will the company find the accident Preventable though i was at slow speed when the trailer swung
4. Will the company post it on Dac?. No damage to Truck. Small blemish on trailer.

Last night around 3am on 12/31/14? Uh... that hasn't even happened yet^_^
1. Accidents reported on MVR isn't based on a cops ticket.
2. No.. if they didn't issue it during the moment, then they can't. Besides, why would they ticket either of you?
3&4, ask your company. -
First of all a DOT reportable accident is at least 3200.00 of damage I could be off on the exact number. Your company will call it an accident as far as you are concerned. Things happen out there. Get in touch with your safety department asap. NEVER admit fault at the accident scene. just say this has happened, etc, never say it was my fault. Always take pictures. Be honest with the people concerned and go from there. Good Luck, slow down more next time.

Dollar amount has nothing to do with whether it is DOT reportable or not. Heck, small scratch on some cars will exceed $3200. Only thing that matters is whether anyone was towed, and if there were any injuries or fatalities. Fender benders with no injury and where all vehicles are driven from the scene under their own power are not DOT reportable.
It IS, however, an incident against you. It'll show up as a property damage/non-injury crash on your MVR, and the company will probably classify it as preventable. Non-preventables are typically deer running out in front of you and getting clobbered, drunks rear-ending you while you are sitting at a red light...stuff where you were doing everything right and stuff happened around you that was beyond your control. You failing to maintain control of your own rig is 100% preventable. Doesn't matter what the road conditions were, or what traffic was doing, or how hard you were trying to keep it all together. Fact is you weren't in control of your rig, you allowed it to leave your lane, and you struck another vehicle. Does it suck? Yeah. Is it the end of the world?
