FedEx was sucessfully sued by their O/Os for the exact same thing. REPEAT, SUCCESSFULLY!

Do you have a source ... It was my understanding the drivers were being paid 1099 as contractors while driving in FedEx trucks, not trucks leased from FedEx.

Actually no ... the law suit's core contention is there is no such thing as a lease operator ... this would include companies as Landstar, Schneider Choice ... etc ... essentially you have to have your own authority, running your own truck or you're an employee ... no in between.

steve...you cant compare fedex to swift l/o fleet. fedex were company drivers even though fedex called them ic. they had to wear company uniform,drive companyy trucks. swift l/o lease their trucks then they sign on with swift to haul their loads. alot of the driver who lease the trucks call themselves owner ops. so how can you say you are an employee. guess whoever started this suit didnt succeed, so they are blaming swift for their failure and wants to recoop whatever money they think they lost.
