NE is 50/50,.. usually not too anal. I've never been hassled in IA.

I do flatbed and my rear axle slides to either have 10'2 spread or closed like regular tandems. I ran a light load in PA and then picked up a 40k lb load on my lower deck which put my trailer at 35,800 lbs. Legal with a spread.. how ever tired and not thinking I forgot to open my spread. So coming into Ill the scale is usually closed at night, they were open. I wasnt worried,.. well he dinged me and I had to come on in. Even as I was bringing my paperwork inside I was still unaware of what the issue was.
He says I'm 35,800 on my tandems. I say so? He says you need to have a spread to be legal. I say oh,.. I'm sorry. Let me open them up. He says I'll have to fine you. You came in how you came in.
I did this once before in Va and they let me get my axles right and I was on my way. Same in Ut when I ran reefer,.. I was over on my drives. They let me slide my tandems to get the weight right and off I went. Not in Ill. What a douche.

That's why you've got to know the rules of the game. 625 ILCS 5/15-112(e) discusses tolerances for weight limit laws. If you're registered over 73,280#, you are allowed #2000 tolerance on axles and 1000# tolerance for gross weight. If weighed on a portable, that gross weight tolerance goes up to 2000#. If you are overweight but within the tolerance, you must park and shift the weight to make it legal. Once you are within the legal limits, the vehicle can proceed and no overweight ticket will be issued.

I've gotten pulled around back at the Roanoke scales and they let me fix it. For all the headaches Virginia is famous for they do have their moments.

As long as he's under gross and not exceeding the weight limits of his tires, axles, brakes and suspension, I don't see it being an issue, at least not one that would stand up in court.truckon Thanks this.
