    I'm so grateful to be getting involved in an industry that has so many stand up people. I just left a company full of entitled brats that were promoted to their position by their buddies, and those who worked hard were overlooked.

    This is already understood; it's actually my major.

    I honestly don't feel like getting into how big business and it's greedy ways has not only moved jobs from American soil but overall takes more than it's willing to give. The trucking industry is one of the few left that goes against that grain.

    But I will say that although it's distasteful and morally questionable, that man has every right to withhold his personal footage for purchase just as businesses have the right to operate the way they see fit; even when it's distasteful and morally questionable.

    He may own the rights of the video for broadcast, but he is also holding evidence. Evidence cannot be held for ransom. If needed, it will be subpoenaed. Plain and simple.

    Burdensome regulations and confiscatory tax policies are the primary reasons corporations move overseas. It is far easier to turn a profit when you need to spend less on compliance and keep more of what you earn. Couple that with a market which places a huge emphasis on low prices, and it only pushes companies to relocate to places with a lower cost of doing business. If they don't, their competition will, leading to loss of market share and decreasing revenues for the company that stuck around. Greed has very little to do with it.

    I would like to find out if your right for sure...as of right now its only your opinion that it can be subpoenaed..
    Thats why there are lawyers employed in this country....to fight for everyone's rights...

    I believe its his right to ask for money for that video...
    I really wish he would let us know what happened with this ....

    If the incident winds up in court, the video is evidence. As such, it can be requested by the lawyers involved in the case, and if need be, subpoenas issued. The dash cam in this case is no different than a store's surveillance camera catching an incident outside of the store. If there might be video evidence of what happened, the lawyers are going to want it...and they aren't going to pay for it. If the person with the video doesn't want to hand over a copy, the lawyer goes to the judge and gets a subpoena. Refuse again, and you can be found in contempt of court. Destroy/delete the video, and you can be charged with destroying evidence. If nobody knows about the video, you have nothing to worry about. However, once you approach the victim and offer to sell him a copy of the video, he knows you have it...and so you'd better make sure nothing happens to it just in case the matter does go to trial.

    I'm right for sure...
    He has the right to ask for money, he just wont get any. It's a basic tenant of criminal law. Prosecuting attorneys and defenders have the RIGHT to all evidence to support or defend their client. If someone has video evidence, it can be subpoenaed. ALL TYPES of evidence can be subpoenaed, and in fact it is quite common to do so.

    Feel free to try and provide a link that would allow someone to withhold evidence from a case.

    One simply CANNOT withhold evidence, for money, or any other reason. It is why the subpoena process was developed. No one should be found guilty or innocent of a crime simply because one cannot afford to buy the evidence.
