    He could get a driving job off road. Just sayin. Good luck to the OP. I would get a legal separation, keeps your money yours and his legal problems his. You can protect your(combined) assets, Not a divorce. This way he would get the idea you are serious but willing to work it out. Good luck.

    when i was a Trooper and someone whined over being caught for a DUI, I just told them to shut up and think how many times they got away with it. DOT federal regs are that if a driver with a CDL is stopped has a .02 BAC there goes the CDL.

    No. The following only applies when performing a safety-sensitive function (i.e., driving a CMV), it does not apply when a CDL holder is not operating a CMV (i.e., driving their personal vehicle). In the case of a CDL holder being stopped when driving their personal vehicle the state statutes for driving under the influence/while impaired will apply the same as if they did not have a CDL.

    CONTROLLED SUBSTANCES AND ALCOHOL USE AND TESTING


    § 382.201: Alcohol concentration.

    No driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater. No employer having knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions.

    § 382.205: On-duty use.

    No driver shall use alcohol while performing safety-sensitive functions. No employer having actual knowledge that a driver is using alcohol while performing safety-sensitive functions shall permit the driver to perform or continue to perform safety-sensitive functions.

    I stand corrected I retired some time ago and it fell under the implied consent law so maybe a state statute sinc CDL's are issued on state levels.
