Driving past midnight...

    Fight it no requirement to stop and filling in log at midnight. There has got to be something that can be done about these over zealous DOT I mean if something is wrong fine but that was not even a nitpick violation it's was a straight up someone who knows nothing made stuff up and is in power to screw with your lively hood.

    So per regulations - your next stop (DOT Inspection), you could of signed the log .. put the miles and started a new page noting the DOT inspection without being hassled or given a violation for it. AM I not mistaken?

    My chief duties for the state patrol is to check the inspections of officers / inspector's reports for correctness. I also handle Data'Q's. If this one came across my desk, I'd remove both violations. (assuming there was no additional information not disclosed here)

    Wow, man they are picking on your ###, aren't they? I am sorry for your misfortune.

    Maryland and Virginia? That just reinforces my stereotypical idea of where some of the worse regions in the country are to run.

    I can guarantee you that officer was wrong you can flag inspections and you dont have to start your next day as long as your duty status didnt change.

    To my knowledge I'm in agreement with the others. But I'm gonna throw in this...if you was on an e log this wouldn't be an issue

    I have been watching this thread since it started and kept my mouth shut, but I must speak up now. It seems that I am the only one that thinks the LEO was technically right. When you pulled behind the scale and set you brakes your duty status immediately changed to on duty not driving. You should have made that log entry before getting out of the truck, LEO must allow you time to make that entry. Was the LEO a jerk, probably, but his was correct in his violation ticket.
    I know the truth hurts, save your money, you were wrong. Just my thoughts for what they are worth.

    I was in this exact same position many years ago, got pulled over on the shoulder, pulled my log book and started drawing my line, Trooper jumps up on my step and RIPS the log book out of my hand and says "you should of thought about keeping your log book up to date before I pulled you over"

    Tried to explain, but got a ticket, sometimes you can be right and still be wrong!

    In 21 years of trucking i only got popped twice and both times were my fault once i was a day and a half behind my truck got a level one and passed so i got a warning and once for being a little over and was told to fix it and was on my way.Dont ever grab your log book and start to write in it when pulled over as dot will assume you were behind and no techically dot was not right as he said you need to start new day after midnight which is wrong and judge will throw it out.
