I-55s at hwy.marker 185 s.of st.louis.Had a blowout and pulled to side of road at the end of the entry on shoulder put on flashers and got out to look because of the reaction of four-wheelers.
Got back in truck and call breakdown and see the weigh station down the hill 1/2 mile ahead.Breakdown tells me to run w/s and IF i get thru to turn around and go to the T/A in ill.Was told only way to get road service is if w/s put's me oos.
Just then i see flashing lights behind me,it.s one of the dot off.from the w/s.he ask's me if i need a wrecker i reply no and he say's"follow me to the station"When we get there he climb's up and start's giving me #### about stopping where i did "on the road"and why i did'nt drive to the w/s before i called b/d.I told him I had just been there a few minutes[the truth]and he said"I'm tired of this ly'ing i've been watching you for a long time?? give me your logbook and bring the rest of your paperwork"
When i get there he ask's why i stopped were i was and i replied from the reaction of the cars around me i thought i had lost both tires on that side of the axle.Anyway he cools off I guess after he see's that my mvr is clean and JUST gives me a ticket for "driving on a flat tire"which i was trying to avoid in the first place.
He told me he gave me that ticket because i stopped were i did.Anyway i was outof hrs.by the time i got the tire fixed and sat there all night listening to these guy's and there replacements pull practically every other drv.in to check ppw.this wa a month and a half ago and their still at it so be up to date on logbook going thru there.
By the way i looked it up in reg.book and it states that if your stopped ON ROADWAY or shoulder you have 10 min.too put out warning markers and that driving on a flat is oos violation so b/d telling me to run scales was wrong[won't do it again especialy since company has'ent paid fine]and the dot telling me to drive to w/s and then giving me a ticket was wrong to say the least![]()

Obviously the DOT does not know FMCSR §396.7 (b) the exemption to operate unsafe vehicles. You can drive on a flat tire to a safe point if the vehicle is more hazardous to repair where it sits. I'd fight that ticket for sure.

You stated that you had a flat tire. Did you have one or both tires blown?
How far off the pavement where you? Did you try to put put out your triangles? You could have tried to get out of the cab and go for the side box. A lot of drivers might have tried to go to the w/s as a safe haven and gotten off the roadway and use Public Safety as a reason to stay off the road. Depending on the type of flat tire you had it might have been better, so go then to stay. How far where you from the w/s to the t/s (or TA). The company really isn't the one who will pay for any tickets that you get (they will find a way for it to be the driver's responsibility). The questions I asked you might be the same ones that may be used if you fight the ticket. Your ticket depending may or may not show up on your MVR but it really don't matter if it is not a "Moving Violation". If you where cited on speeding and you weren't then it would matter. One word on caution though, IF you do not fight the ticket the state can put on your MVR that your license will be suspended and that will show up on your MVR as Failure to Pay. Oh! yeah a few more questions on this matter that you might ask yourself, Do you pay into one of those (legal) firms that will show up for you?, Do you live in the state that the ticket was issued in?, Are you sure that your company will route you in that direction when it is time to show up in court? Fight or Not it is your choice, but weight all the options then figure which one is best for you. Good Luck -

That would still have the same exemption to where he could have drove to the scale and got the tire fixed. I don't know where this DOT officer got the idea that the truck must be repaired right there on the highway. I sure would fight it.
That town you live it sure is small. I had a lady friend that was killed on the highway when she walked across it. That was way back in 1980. I'd come up to her on weekends and we got to know the local people when we went to the watering hole. It was a different place that's for sure. -
My town is small but it has grown a bit since I've been here. I moved my family from Highland Park, CA to here in 1996-97. I really like it up here. It is really sad to hear your friend was killed on the Hwy the cars and trucks seem not to see the speed limit signs which is 45mph in town (I think that is to fast for any main street). D/Drivers and dopers cause problems, I've lost two friends to these type of drivers over the years.
Joshua Tree only has one watering hole (that I know of), two gas stations, and room for trucks to park

like i said by the reaction of the cars around me i thought both tires had gone and pulled to the side of the interstate to check.only the left inside rear tire had blown on the trl.as i said i was'nt given much time before dot showed up and i thought you had 10 min.to put out triangles?the t/a that breakdown wanted me to drive to was in ill.i believe ex.15 on 70.
and yes i recieved a late payment notification in the mail and the company paid the day before my licence would have been suspended.
and no it was not hazmat just beer from the original plant in st.louis.
