I recently got terminated from Whiteline Express and asked them to send me my long form physical. They told me that even though its my medical records, they arent obligated to give me them since they paid for them, and its their property. Also, the doctors office will not give them to me either, and said i have to call Whiteline. What gives and what can i do to get my long form? If i need to get a lawyer involved i guess i will.
Whiteline express wont release my long form.

Why not to get new one?
Straight Stacks Thanks this. -
Get a new physical? I shouldn't have too. These are my medical records, id assume they would release them.
-
Why retain a lawyer when getting a new physical will cost you a lot less? Technically you were let go (for reasons none of us know since you didn't elaborate and my crystal ball is currently out of batteries). They may have had a clause in the contract you signed retaining all physical documents including medical if terminated for a specific reason...usually buried in the fine print that most drivers neglect to read.

you should have got a copy from the doctor when you took the physical..... if you inform them that you want a copy because by dot regs you are suppose to have a copy of the long form in the truck as well as the dot card
runningman0661, RustyBolt, Lspilot82 and 2 others Thank this. -
Lawyer $500
New physical $90
You do the math.HalpinUout, dog-c, truckon and 2 others Thank this. -
I always ask for a copy of the long form when I get a physical. But trying to get a copy from your previous employer is a fight your not gonna win. You would be better off getting a new physical and get a extra copy of the long form. And most employers will pay for your physical before you drive for them.

A smart lawyer would charge you 100 to tell you to get another physical.
truckon, Straight Stacks and Lspilot82 Thank this. -
Should have had your long form with you in the truck while you was working for previous employer and take when you get your belongings. Not getting why you would have to get a different copy from them?
-
If you didnt pay for the physical, company is not obligated to give you a copy its a fight you will not win.Next time ask for a copy at drs office or pay 80-90 dollars for physical.
