    I'm not battling over this I don't even have a cpap.

    I was just curious as to WHY everyone who does have to comply doesn't find it intrusive on their medical privacy rights and the fact you are no different than a company driver under this policy. It's not DOT mandated YET.

    I think it's a great thing for those who have the condition and treatment helps it's just amazing how much we give into some company driver policy even though we are supposed to be IC.

    Guess it's true we do just pay for a job.

    No different reporting requirements for diabetes. Condition that affects fitness.

    FMCSA DOES need to offer something concrete though beyond suggested protocol.

    Heres what I know...I am new IC first question in ProMed health screen was sleep apnea I said I have had a machine for over 20 years. In the end over tons of emails and questioning am I being held to "employee" standards or am I an Independent contractor. ..bottom line new machine my cost, there are slightly used machines for half of what Schneider charges for them although there price is very competitive...Iwas required to sleep 2 nights with it and submit the download. All way fine then. What I can tell people is BUY the AUTO unit as you NEVER have to have another sleep study. Personally it pissed me off spending the money...

    Capt. Dave can you elaborate on the Auto unit and no more study when I was a company driver about 5 years ago I already had a machine they didn't have a problem with it just had to send in compliance report/download every 3 months

    It is dot mandated. If you don't provide proof to a medical examiner you won't get a card. Now as an independent you should be able to handle that yourself without Schneider babysitting you but we all know how Schneider is in that regard

    Spoke to the sleep lab lady in Texas this morning said my 8 year old machine is not good enough for company drivers but would be allowed as an IC I just have to fax her a copy of compliance and my sleep study/ prescription for equipment

    What's the FMCSA rule #
    Dot has guidelines has not been mandated as far as I know but if it is a regulation direct me to the #.

    Last I was told it's not a DOT requirement to be screened for sleep apnea to get a med card.

    If anyone has a different understanding please share.

    Maybe not but if diagnosed there are compliance standards.
