talk about bad luck, i have had it. i got out of the wheelchair from last back surgery 2 weeks ago and finally started somewhat walking again. i felt like i was doing very well, but then i get in my car to go for a doctors appointment last friday and got rear ended at a traffic light by a dump truck and the bad thing was that i had been sitting at this light for a little bit waiting for it to turn green. then i get a separation notice in the mail from usa truck today. can they actually fire me if i had a chance at getting better and going back to work ? it all sucks but i guess the good thing is that i am alive. but now my car is totaled and i have a broken leg, a broken nose, 2 broken fingers, and a black eye . on the other hand , my back was checked thoroughly for any more damage and there is none , thank god. i now have to be on crutches for a while but i guess its better than being in that stupid chair. i feel like maybe i should just hang up my keys, throw away my driver license, and just forget it. i do wonder if anyone else has luck quite this bad. but maybe after my leg heals, i may start trying to find another job. hopefully that wont take too long.
what sorry luck lol.

Aren't there labor laws that will protect your employment in the case of a legitimate medical reason...assuming you have a written doctors excuse. I don't believe you can be terminated on those grounds, however you won't be eligible for pay or benefits during the absence...I recommend you contact someone with legal knowledge in the state you are employed to find out more about your rights as an employee. Did the dump truck not plan to use any brakes at all?. You should have them inspect the truck chances are those dump trucks won't pass a level 1

The OP lives in Tennessee; dump truck companies there write their own rules.
The cops in that state will pull an 18 wheeler over if they think a mudflap is 1/4 inch too short while ignoring dump trucks speeding, slinging rocks onto the roads, ignoring stop signs, etc.bubbaray30 Thanks this. -

Wow, Bubbaray, if it wasn't for bad luck, you'd have no luck at all. I agree with Truckon, if this was me, my driving days would be over, and I'd go after the dump truck full time. Pretty hard to lose this case, but rest assured, they will try and claim you backed into the dump truck. Good luck, and I'm glad you are ok, somewhat, and settle in for a long fight, but you will come out on top,,,eventually.

I don't know what your first injury was from but a family member of mine had the same exact thing happen almost exactly. My mother had a spinal fusion done on her neck from years of small injuries and deterioration. No wheelchair required but a couple weeks of bed rest followed by a month of light duty. The day she's going back to work she was stopped at a light and a small box truck rear ended her at 40 mph. The driver admitted he never tried to slow down and claims he didn't see her but the light was red so obviously he was distracted by something. The car got totaled and she had to have surgery 2 more times. She lawyered up and got 200k from the insurance company after their cut. She could have have got more had she went after the companies assets and the driver but the money covered the medical expenses and lost wages. People make mistakes and there's no reason to try and get more that you deserved. Get a lawyer my friend and good luck. I hope you heal quickly

I don't think you're going to need to work any longer. Capt dump trucks company is gonna owe you a tidy sum. That's gross negligence. Don't let them off. If your conscience is clear that you were 100% in the right, get 'em.
