Here is a video link that tangentially addresses these issues as they relate to CARB oversight.
http://www.arb.ca.gov/enf/reports/poe.wmv
Yes the video is rather long and boring but it does address the issue of trade agreements and how that factors into the CARB mandate; there is also some comic releif in the form of an ARB inspector who watched too much Gomer Pyle or is the reincarnation of Jack Webb from the movie The D. I.

Newsflash Stay.... I was a successful independent for 10 years. Showed a profit for all those years except for 1 year. I know what it takes to run a truck/s and I know how an independent thinks and operates..... Winning.....
-
Good for you!!! Run freight and lanes that are profitable for you.... I don't care.
-
If the lowering off truckers wages is all the fault off CARB then pls explain how come most drivers that have never and will never been anywhere near CA have lower wages.
I'm not talking about those that don't want to run CA but those that never will go there just because their freightlanes aren't anywhere close to CA. -
Neither I, nor the poster who mentioned "deregulation and globalization" suggested that CARB regulations where responsible for the current pay paradigm. I agreed that trade agreements and the deregulation of the industry (ironically replaced with increased regulation of drivers and the busting of union contracts) has more to do with the current status than any regulation put in place to increase safety or environmental quality concerns; but of course corporate spin doctors will paint a completely different picture.
Add in the blather of AM fatman political talk radio and the general misunderstanding of what this regulation actually involves and you get a morass of confused and uninformed rants.
California is the world's 10th largest economy. Why would any business not want to participate in that potential especially when the requirements for compliance are not a huge hurtle? The Admiral and daf105paccar Thank this. -
This is California in essence enforcing it's emissions requirements on vehicles not registered in California. If California wants to regulate that for vehicles registered IN California or to conduct business intrastate by all means go ahead, but to require all vehicles to comply in order to operate seems to me to be infringing on other states. What's next, states deciding that if you possess a CDL from a state known for issuing them to illegal immigrants, like New Mexico, that you can't operate a commercial vehicle in certain states?Al. Roper Thanks this.

Setting aside your false dichotomy; the question is can a sovereign state establish standard individual to that state? Can a state establish on federally funded interstate highways speed limits?
Any state can create laws and regulations that dictate business and industry standards. No one is forced to comply if they choose not to do business in California. If an out of state driver wants to compete for freight in the California market they will have to operate on a level playing field with instate drivers.daf105paccar Thanks this. -
huh? no one ever checks anything right down to the ARB # on the reefer
-
Like I said, they can regulate business inside their state but freight coming IN to California and leaving OUT of California is INTERSTATE commerce. California is essentially saying if a truck doesn't meet standards that a California registered vehicle must meet, but meets in it's home state it can't be operated in California. Seems to me that violates the Single State Reciprocity. If California doesn't want to allow non CARB compliant trucks to operate intrastate, I have no problem with that.

Uh... Really. Ya might want to check on that.....
