General question. I was recently leased on to a small flatbed bed company. Coming from a large motor carrier who had all their paperwork in order. Just recently realized, as I was looking at my cab card I was not permitted to drive in certain states or more accurately the company I was with was not permitted. Small company and probably an oversight with all the things a small company has to maintain. The lease agreement states all permits are the responsibility of the motor carrier. Do I have any liability as an owner operator. Can I be ticketed or fined or does it fall back on the motor carrier. This was caught within three months after starting so I would like to fix it know before it becomes a possible problem later.

As the driver of the vehicle, if you get caught without proper licensing and permits, you are the one that is going to get the ticket. I had that happen to me back in the 80's, never let it happen again. Know where you are licensed, if you need a permit to go somewhere, talk about that with your carrier, they are responsible for obtaining the proper permits for you, but you are responsible not to operate illegally in any jurisdiction.

I do not operate with them anymore just drove for them to get experience with flatbed. Wasn't sure since they have to file their ifta report if it should be addressed. One of those things where I informed them I would only be one for a short while. They agreed but once I started the process to get my own authority it became awkward. So I guess they anticipated me not getting my mc and thought I would stay on. I finished my obligations and did not burn them but its not like we talk now either. Just waiting on my 1099 from them and I will address it. Is it on the carrier to file the 2290? Trying to make sure I did not leave anything to address later. What liability could come back on me? If its a permit issue wouldnt that come back on the carrier. Is it just a financial penalty?
