So what happens if...

From the pics it looks like you got off easy with an OOS. A few more feet and you would have had a roll over. Thats not something you want on your DAC. On the ticket if I'm not mistaken it depends on how its reported to your home state. I got put OOS in New Mexico about 10 yrs ago for a trailer during their weekly shakedown and got a fix it ticket. 1 month later Ar sends me a notice that I was charged with driving an unsafe vehicle. took 3 yrs to get that sheet off my record.

 

Okay...now that makes more sense.

Typical OOS fine is about $125 depending on the violation. Log books carry a heftier fine...but most others don't

I would say this is (should have been) a straight out failure to maintain control. And you're going to pay it, even if you get a lawyer.

The DOT officer done you a favor. Do you really want to argue this ticket?

You just provided the states evidence against you...arguement over. Done.

Fight it, and it may cost you a lot more when the evidence is brought to the judge. I would be very careful about how my lawyer approached someone wanting to deal.

I would rather have the OOS ticket on me, than a failure to maintian control. AND an avoidable on my DAC.

 

I would have to agree. It looks like your trailer sat down on your drives. Due to the angle, it probably snagged a cross member or something else while you were being pulled out.

 

I was wondering if that might have been the cause - rock 'n' roll trailer, wanged way over on the one side and ate a tire. Hard to tell if the scuff-mark is related or not.

 

The cut tire is on the front drivers side axle, and the trailer is off on the passenger side. It looks like two seperate incidents to me.

The pictures are hurting her more than helping. Look at the tractor in the right lane pointing toward the left, where a proper turn should have the truck pointed the other direction from swinging wide to make the turn off. The fact that both sides of the trailer are off the road also indicated a failure to swing out to achieve proper clearance.

As far as the tire goes, crossmembers would bite into the top of the tire, not all the way aganist the rim, and that tire had to make some noise when it let go, no matter how it happened.

We all make mistakes, and this looks like two seperate ones close together. A driver always wants to put the best spin on things. You are the only one who should know exactly what happenen.

The best thing is to know what got you into this situation, and not let it happen again. As I said earlier, we all make mistakes. What's important is that we learn from them. That's what sets the drivers who will go on to make it apart from the ones that don't.

 

Yes I think you should proceed very carefully with this matter also! My husband got charged with an avoidable accident, when his back tandems ended up in a ditch, on a very narrow road, the police officer stated, that this had happened to numerous trucks, just in his 2 years on the force. But any way, he was towed out and went on his merry way, and they put on the dac avoidable accident!!! Just be carefull with them I would hate to see them mess you up, just because they can!!!!
