    It's not often drivers are on the same page,it's nice to see we're all aggreeing not to drive that trk and the op is listening and taking everyone's advice.

    Of course tug tests are a great and mandatory thing; but I never feel 100% comfortable unless I get down under the trailer and see that little bar coming across the fifth wheel holding on to the king pin.

    Just spoke with the shop. They were going to rebuild the 5th wheel today, so I could run when fixed. They said that "the top plate was shot" and it could not be fixed today. I told them to call my manager.

    Waiting.

    Definitely not my business, but I'm wondering how your lawsuit worked out. I wish more people would stand up to these unsafe companies. Or simply not choose to work at them at all. (I guess easier said than done if you really need a job)

    Company settled out of court.Jason was supose to put in his words what happened on paper a,d have it no later then a certain date on the judges desk.that never happened.so my lawer and his lawyer talked my lawyer called me and gave me one settlement I said too low.he calls back later and I settled for 15 K.Jason had sixty days to come up with the money.it wasn't at all about the money thru the entire ordeal .I wanted to show Jason I wasn't going to back down.his lawyer sent something to FMCSA why the charges should be dropped.FMCSA didn't give in.so they sent something to the judge handle my case and days later Jason got a statement back from the judge stamped a cross it was request denied.my lawyer sent me a copy that was like sweet revenge.

    glad they are fixing it but, why couldn't they tell the top plate was shot when they had it in the shop last week?

    The wait will be well worth it, and I firmly believe you scored Safety Points with your Company. They now know that when you tell them something is wrong with the truck, and that problem adversely impacts safety, and that you cannot drive the truck in that condition, the company will give you less of a problem -- should they ever question you again in the future.

    Good going for accepting the advice provided in this thread.
