Here's the thing. I'm leased to a company as a 1099 contractor. The company benefits greatly in this regard. That's why they like to lease trucks. However as a 1099 contractor as far as the IRS is concerned I'm independent. If the company takes too much control they lose the ability to classify me as a contractor and must classify me as a W2 employee incurring unemployment, disability, and social security taxes they don't pay now. I pay them. When a company has an employee they bare a portion of the tax burden. You may not have known this. Now why would I care. For one I want to drive faster and I'm not sure it's legal for them to govern me. Secondly if it's not legal then I want to be compensated for all the miles I've run while governed. Such as the company paying the portion of taxes they owe if I'm not classified as 1099.

So how many weeks you working now and how may miles do you run in a year?

I do not understand why someone that leases a truck compares it to buying a house instead of leasing a car. If you lease a house do you own it? If you lease a car do you own it? Why should the term lease magically change if you lease a truck. Oh it doesn't. A lease is a lease so NO you have no say. Well you had a say up until you signed that lease. Now you have no say. If you want to own your truck then buy out the lease. Then whatever company you leased on to has less say about what you do to what would now be YOUR truck and not THIERS.

OP I'm willing to bet you are under TWO leases. One for the truck THEY own and one to use their truck under their authority.

Could be. Problem is I don't know what I don't know. There are known unknowns and unknown unknowns lol.G13Tomcat and CJndaTruck Thank this.

Miss a payment on your mortgage and then explain your logic to the bank.
-
Oh so you own your house if your making payments but you're a dirty low down son of a batch if you lease a truck. Ok I see. Really dude if you don't want to add to the discussion then p$ss off.
-
If you miss a mortgage payment the bank can do little. Now miss several and it still takes them months to forclose on you. But miss a lease payment and see what happens.
