Potential civil lawsuit against Stevens Transport & Hireright

    Hello,

    My name is Germaine . I have been driving now for 8 months and change (at least, since the time I posted this message).

    I started driving back in June 2015 with the above mentioned company as a trainee. My first trainer was great but since he only ran dedicated I was told from the get-go I could only stay with him for two weeks.

    The second one turned out to be a complete scumbag and I sacked him after 17 hours.

    The third is one turned out much worse and was the focus of the issue.

    My last trainer, Denoris (truck number), bragged to me on our first night about the kind of women he has been sleeping with, ranging from deadbeats to women with 8 kids.

    One of the girls he bragged to me about is how he and his friends have been "gangbanging "this 16-year old girl from Florence, SC for the past 10 or so months [before the upload of this video]. He even pumped his chest about her mother giving him permission.

    I spent half the time in his truck not wanting to beat the #### out of him...



    After managing to record him admitting that he did such a deed, I returned to the company to present my evidence. Once I did, the Safety Director, Adrian W, spent a good 40 minutes trying to dig into my background and see if I had enough dirt for him to use.

    Once I made it clear I wasn't no criminal, [the safety director] promptly tried to keep a lid on the matter and buried it. A little birdy told me he was contacting lawyers to see how he could harm my career since my trucking performance far surpassed even some of the company's veterans. My safety performance was more exemplerary.

    When he found out that I knew what he was up to and started taking steps on this, he fired me (supposedly, with the senior management's approval) and gave me a "Disqualified for Safety" etiquette with no reason given.

    I was defamed, retaliated, harassed and wrongfully terminated for blowing my whistle on such a disgusting thing; regardless of the legality of it, I never knew of any person to go around and brag about having sex with kids.

    Needless to say, I followed the advice given by a few friends of mine and managed to come out of the problem unscathed. Even now, they are still trying to slander my name to no avail.

    By now, Stevens rightfully suspects that I have recorded my conversations with them which included having the Safety Director arrogantly state he and the rest of management agree to falsely disqualify me to fire me. However, since I haven't presented any case yet, I don't have to turn in any evidence.

    A group has been working for the past 5 months to build a big enough to go against both Hireright and Stevens Transport. The main rationale that allowed this to get started is the very nature behind the slander: they must have done this before. In short, we were supplied with thousands of former drivers who have also had similar experiences and had their records falsely sullied.

    I am fortunate enough to still be able to drive thanks to other sources I managed to get acquainted with. I do know a lot of former drivers were unfortunate not to have the same luck.

    Please contact me if you believe that the same thing happened to you.

    Just for the record: if you were involved in a fatal crash, DUI, theft, assault, or any action that could be deemed criminal don't bother. We have gathered over 3400 confirmed, clean cases. We are looking for the magical 5k. But every single one of them didn't have the issues listed previously and we aren't looking for it.

    I can't quite figure out why the company would come after YOU for turning this video over to them. Who is this "trainer" and what does he have on the company , or...who are his friends at Stevens?

    If I were the company safety director, I'd be looking into the allegations of the trainer and HIS past history, not yours for blowing the whistle.

    Something just seems extremely fishy about this whole scenario...

    Any co. doesn't want "troublemakers" on board because of legalities. Much easier to get rid of them and go on with business as usual. In their eyes, you're the troublemaker.

    What you are trying to attain I presume is class action status for something like wrongful discharge or something like it. If that is tge case, I would do follow your attorney's advice PRECISELY. They have multiple ways to find other potential litigants. Make sure they want you to post information on a public forum like this before you do it. It might complicate your case if done improperly.
    Generally as a part of the litigation the attorney's would gain access to a mailing list of discharged employees, a much more effective means of finding other members of tge class.

    I'm not saying what you did was wrong, but I think you, and the process in general, would have been better served had you presented what you had as evidence to the authorities, i.e.; police.

    Yes, get the criminal conviction against the trainor and make the unlawful termination a separate case

    16 is the age of consent in SC. If the encounter was consensual and the young lady was indeed sober and cognizant, then no crime was committed.

    As repugnant as it may be for someone to brag about their alleged sexual conquests, it appears the OP shot himself in the foot here and any litigation will prove fruitless.

    I belive your missing the ops point. The trainer doesn't have much to do with the bigger picture. It's about unjust termination and conspiring with another party to slander individual and individuals to hurt future employment. I hope hireright gets everything they desrve. Total shakedown artists that conspire with crap trucking companies
