If it's old/junk equipment they are always recalcitrant about fixing that's your cue to take a hike. They are putting your license at risk plain and simple.

 

I think that's exactly it. We get paid to drive miles and not paid to fix stuff. Sometimes I feel like I am the only one stupid enough to get stuff fixed.

 

I worked for a company like that back when I was a newer driver.
I intentionally pulled into a roadside inspection station here in NM even after I had been waved through by DPS. The officer I talked to asked why I pulled in and I went over a whole slew of problems I was having with the truck and the company.

He offered to do a Level 1 but not cite me personally for anything and he also gave me the number to his sergeant so I could get more information about what kind of recourse I had. Called and talked to the sergeant and he told me that I could file a Compliance Review with NM DPS and, of course, provided me with all the information on how to do that.

About a week after I submitted the paperwork and supporting documents / photographs, 7 DPS officers paid a visit to that company. 3 officers went through years and years worth of records, receipts, paperwork, etc. while the other 4 blocked off the entrance and exit gates with their cruisers and inspected every single truck and trailer in the yard. Being that it was a local company (in-state only), all the trucks were there. The officers ended up putting 11 of 26 trucks OOS right there in the yard while the remaining units had at least a couple citations each. The officers inside discovered so many discrepancies, including guys with suspended or revoked licenses driving CMV's, that the company had to "lay off" almost half of their driving staff. Company ended up with around $100k in fines from the state, had to spend another huge amount of money on parts for stuff their mechanics could fix, and then wrote more checks to the local truck shops to fix other problems. All told, I think they ended up eating almost $350k....

All because I told a mechanic that my truck, a fuel tanker, needed new brakes. His response was "Well just don't stop so much and you won't need new brakes."

 

So we can defend ourselves, what law is being broken?

 

They can't fine you anything and if they do leave them they are a worthless outfit to haul for. That just goes to show you that an outfit like that it not worth working for. CSA? why don't you ask them when is the last time they put tires on your trailer and tractor Still paying cash for tolls?. Brakes are always good as well. Aligment?... oil leaks? lot of new companies out there putting unsafe used second hand junk out on the road
