E-logs will equal more parking

    Not being able to find a parking spot in a truck stop or rest area does not qualify for the emergency 2 hour exception!

    Adverse Driving Conditions 395.1(b)(1)

    In case of any emergency, a driver may complete his/her run without being in violation of the provisions of the regulations in this part, if such run reasonably could have been completed absent the emergency.

    If the following conditions apply, then you can drive for up to 2 additional hours ( 13 hours total, as long as you do not exceed your 14-hour rule. All Steps must be met- see step below.

    1) You unexpectedly run into snow, sleet, fog or other bad weather or a highway covered with Snow or Ice or usual road or traffic condition

    2)The person who dispatched your run was NOT and could not have been aware of those conditions

    3) The run is one that you could have normally complete in 11 hours and

    4) You are able to complete the (extended) run without exceeding the 14 or 70-hour limits

    YOU CAN NOT use the adverse driving conditions exception for delays that YOU should have known about, such as congested traffic during rush hour.

    I didn't assume anything, I knew what you were referring to. Now if your Safety Director made this claim that you could drive past your 11 legal hours and gave an example like you did...of getting home instead of a truck stop 30 minutes away...your company needs a new and better informed safety staff, beginning with your "don't know nothing" safety director.

    But, I also think you might be calling in the expertise of some US Marshall to verify what is printed in the "green book" also known as the FMCSA Rules and Regulations handbook.

    Now here is an example of someone who is assuming something that is so far from fact that Lewis Carroll would consider him for background stories apprentice for the second edition of Alice in Wonderland! @Straight Stacks I think might find this funny if he could catch his breath long enough to laugh!

    I love these e-log and EOBR threads...so many say so much coffee counter gossip as fact statements...you have to wonder how so many passed the multiple choice written tests to get their CDL!

    Yes DOT does not make the regulation, but they are charged with collecting data for studies and enfacement of adopted regulations. Thank you for the procedural lesson… further response to your comment/question. I’m not an authority but, it is obvious neither are you or you would be familiar with the events at hand.

    Congress wanted DOT to do truck size and weight limits study in effort to potentially move greater amounts of freight to address increased capacity needs. DOT (Headlines: DOT Throws in Towel), in summary, said that they do not not have manpower to collect the data required to provide a comprehensive study and report to support Congresses request. In short, DOT arbitrarily recommends to not change current laws to increase size an weight limits. A link to inform and start you on a trek to research should you choose.

    Yes, E Logs are to go into effect, DEC. 2017, under current ruling, However, with the battles and numbers of lawsuits challenging the ruling citing for one, a lack of data collected to make the determination, the mandate will be defeated and repealed. ...Ciao...

    Welp according to the experts in this thread, the next time there is an unforeseeable delay being unloaded at the airport i guess i just have to tell the faa officials at miamidade international that their runway will be blocked another 10 hours for my 10 hour break. So all those flights need to be diverted . Ya that's gonna go over real good. So good in fact i wouldn't be surprised if i got first hand knowledge of those us marshalls you mention. But something tells me it won't be a friendly meeting.

    Whether you interpret it to the letter or to the best of your knowledge, or whether you take full advantage of the hour(s) or just use minutes, it just doesn't matter if nobody ever checks your logs. If I run 11:29 minutes today and go into sleeper at 22:00 at the 14th hour of the clock, how are you to prove the conditions that you faced 6 days later when DOT simply asks and reads your marks. Has anyone ever dealt with an office person or a DOT officer going back to the date and researched whether conditions were bad enough or whether an accident occurred on a specific time and date that blocked all lanes? I mean.. Come on... They aren't going to do that. They'll just give you a ticket, id presume. Or let it slide. I don't know. But if your on paper, that would never get written down. I don't know about elogs but, you can go through a year without dot checking your elogs.

    Elogs will decide for me when and what, so the HOS is only the half of the problem. And i dont want to pay for it, it is not free of course

    No, the hos regs decide for you. The eobr just records if you break the regs.

    The biggest challenge for me its gonna be my sleeping time. I usualy can not sleep during the day and when i have to drive nightly i do not thing i will be the safeties driver on the road but the ELOG will push me to drive.
