Usually the state where the company is based. Sometimes companies hire management companies in other states to handle workers comp, payroll, etc.

Thanks can you help me with something else the comp u work for was deducting 200 a moth for workers comp now they want to stop doing this but they want me to sign a doc releaving them from paying anything if I'm injured on the job is this legal?
-
Do you get a 1099 at the end of the year or a w2 showing how much you made?
-
At any rate, it sounds shady to me. Might be a good idea to talk to an attorney about it? Ive never heard of a company taking 200 a month for workers comp from an employee and most companies have to provide workers comp for employees, with certain exceptions, as required by law.
G13Tomcat Thanks this. -
@truckersjustice might be a good one to talk to on here. I think hes an Attorney?

I get a 1099

Are you aware if your getting a 1099 at the end of the year, YOU will have to pay taxes on that. Also it seems by you signing that waiver, if get hurt on the job, you won't collect workman's comp. Most States required the employers to have workman's comp to the employee. Like said above.......sounds like your driving for a shady outfit. I would run far away from them.
G13Tomcat Thanks this. -
If you get a 1099, you are not an employee. If you are treated like an employee and get a 1099, you are misclassified. A call to the IRS will get it all sorted for you and your "employer"
G13Tomcat, double yellow and Diesel Dave Thank this. -
A contractor must buy their own workmens comp insurance or go without. Regardless they are not entitled to same workmens comp allowances as regular employees.
Sounds like the company lost the ability to offer a specific group workmens comp coverage for it's contractors, and is now requiring them to find it elsewhere
