Had an accident today.

    Was going along down the interstate on I 55 in Memphis east bound right before the bridge. Car comes in off a ramp and slams into my drive tires. Cop shows up and 4 wheeler says I changed lanes and hit him. Cop agrees cuz he found the guys mirror in the middle of the lane. I pleaded my case to no avail...I got the citation. Gave me a court date. They also mentioned there is cameras in the area and that "accident investigators" will pull the footage and look at the report and make a final determination on guilt and give me a call in a few weeks.

    My question is how should I go about this? I'm not lieing, he came off the ramp and tried to merge right into my drive tires. I don't want a preventable on my record but I'm worried since the cop judged me guilty I'll have a tough time overcoming it in court. Thoughts?

    Always good to lay down a bit of rubber to mark your spot at impact just for this reason.

    Seriously, why don't you use a dash cam? Even a $20 720p would show what happened.

    I think Id go to court on it and tell the judge your side of the story. Just tell him you know you were in the right lane and tell him when that mirror came of it could have went anywhere, especially if it got hit by a tire or bounced in the road. Stand your ground on it but be polite.

    I had a guy run a redlight and run into the side of my trailer. He convinced the police that I was the one who run the redlight so he gave me a ticket. I went to court and told the judge my side of the story and must have convinced him, he dropped the charges against me, for both the accident and the ticket. I didnt get unruly or anything like that, I just told him how it happened.

    This is where you get a lawyer. A good lawyer. The fact that the mirror landed where it did and a cop believes that to be evidence is total BS. I have a PhD in physics and without doing measurements and knowing speeds involved there is no way that the cop can tell where the impact happened. Things bounce.

    Now, the cop writing you a ticket and saying it is your fault would be both Libel and slander. Sue the City of Memphis and the other driver. Go at them hard. Get angry and then get even. Hitting you and lying about it is an attack on you and your family. Make them pay.

    And if there is a Sky Cam someplace, request the footage and use that if needed.

    And yes, a cheap dashcam would be a good idea

    I hope that you had a camera, film is the best. hard to photoshop that. Also hope you took lots of pictures. Of the road, the car, your truck from every angle you could think of.

    hire an attorney, have the attorney request info on any cameras pointed at the roadway and the file lifetime on what they record. if it covers the date of your collision, have the attorney subpeona the files.

    also have the attorney subpeona the drivers phone records, including GPS info.

    in addition have the attorney subpeona the cars ecm info for GPS, speed and brake use. ( if the car is over ten years old this may not be available)

    this last item is also a good source. facebook, twitter and other social media sites. do a search on the driver, see if they have any postings related to the collision. keep checking it. you would be surprised at what things you can learn from sites like that.

    your insurance company will run the drivers history as part of their fruad check and may also run the drivers license.

    your attorney may be able to request that info from them, or may have to subpeona that info from the state and insurance company.

    finally prepare a full written statement of what happened. be as detailed as you can. use plain language. give copies to you company, insurance company and attorney. then read it over and over until you can recite it word for word with out a bit of hesitation. your going to need that.

    one more thing to talk with your attorney about is the counter suit and complaint you will file against the LEO that cited you.

    last bit of advice. speak no more of this with anyone other than your attorney, your insurance company and possibly the saftey person at your company. no more posting about it any where as well. if you have delete them now.

    While this advice is free, I can tell you it comes from a real world experience. the difference was it was the trailer, right between the spread.

    If they are pulling video from cameras at the scene, they should help tell your story. Are they talking about DOT cams, or stuff like ATM and security cams?

    That bridge should have cameras around it.

    Make them pull any that saw your crash.

    I would repeat what Expressolane said.

    Good luck to you. That bridge is one of the most important in the United States. They just finished fortifying it to stand through a 8.0 that will come.

    I Hope it does. If it does not, then US Navy LCACs will be needed to transfer trucks across two at a time.

    • hold your lane and don't worry about moving over for merging traffic.
    • Don't drive in the middle lane to reduce merging issues.
    • Let them hit you, you'll be okay.
    • Don't worry about defensive driving, drive for yourself only
