I knew this guy that had a similar thing happen to him he said instead of defensive driving he said he went on the offensive. When a 4 wheeler was coming up ramp trying to push into his lane he pushed back and slammed him into the ditch he then kept going and taught that 4 wheeler a lesson. He is a outlaw trucker part of the 1% stops at no scales.

it doesn't matter that much who hit who? your dubbed as a professional driver. meaning you should of been able to recognize the accident was going to happen before it happened. the dash cam wouldn't help you that much on a side impact. only thing it would have shown is you were in the lane you were in. which would have sparked a couple questions. why didn't you slow down? why didn't you move over to let the now victim on the road? it's going to get spun back on you? I would take the advice from the poster who has a PHD in physics. Get a lawyer! a good one. I promise you the other guy already has one. and they are planning a multi million dollar suit against you. there going to claim as much property,physical, and psychological damages as possible. so as quickly as possible. you need to get the background on the person who hit you. and find out as much dirt as possible on them. in addition i would get a court order for a drug test. and pull there medical history to if they are taking any medication that impairs them from driving a car. there's a whole lot you can do to put the case in your favor...

The argument of "letting the victim on the road" doesn't jive. If it's a merging lane, it's the merging traffics job to yield to traffic in the travel lanes. The dash cam would support his claim of being in his lane of travel.
