that's how they are going to fight it!!! there going to be banking on who dumb the driver is. I went through something like this with one of my drivers. I have 5 trucks. after that! this is what i do! i tell every driver i hire. when you are out of the truck dealing with the public. set your camera in your phone to video and hit record. then put it in your pocket with the camera on the back facing out if possible. I cover them everywhere else with a 16 zone camera system. 8 on the tractor, 4 on the outside of the trailer, 4 on the inside of the trailer.

Problem with recording conversations such as these are many states it's inadmissible in court unless all parties being recorded are aware. Some states only take one party top be aware

I think I'm going to wait for the call from the accident investigators. Hopefully they can see from their cameras I was maintaining travel in the right lane and not merging. If they side with the cop I'll defiantly lawyer up. Thanks for all the advice guys

news flash. no body cares about that law anymore. freedom of speech is your worst enemy in this day and age. the right to remain silent at all times is your best friend. in a cmv related accident the best thing you can do weather your the trucker or the motorist. is keep your mouth shut. my camera systems also record sound. the only thing i had to do. is post a sign on the drivers door and the trailer. stating video/audio surveillance in use. it's not my fault if people don't read the signs.Skate-Board Thanks this.

If you "wait and see", you may be allowing a piece of potential evidence to be lost. What if those cameras DO show something, but it doesn't get investigated in time and the video is overwritten? Get on the ball! Get those videos and watch them for yourself. Once they have been requested, they are evidence, and destroying them becomes a criminal offense. If they have not yet been requested? They are not evidence and can be destroyed. If the request was made after they are gone, nothing anybody can do. If there were videos, you need to get them ASAP. Don't wait.
