i want my paycheck.

    owner of truck is leased on with a company. my husband drives one of his trucks. he has no benefits and does not take any taxes out. My husband had a accident. not with another vehicle or truck. his trailer caught on to another trailer and knocked it off its dolly legs. now owner is keeping pay check to pay his deductable. can he do that to us???

    Most likely since your husband hit the trailer. What does your employment contract say?

    Yes, unless listed otherwise on contract. If someone was mowing your lawn and rode the mower into the side of your house would you expect them to pay for the damage?

    Then he can do whatever he wants since there is no contract between you and the carrier.

    Why do people accept a 1099 job and get suprised when it turns out the owner is a crook? The whole 1099 thing means the owner (amd to some extent the driver) doesn't care about what is legal, so why be suprised on all other shady stuff?
    As for advice call the labor board and see if they can help getting your hubby classified as an employee. Otherwise its just one business (your hubby) disagreeing with another business (the o/o.)

    Actually some owners do care and use 1099 with a contract, it is many times the fault of the driver to take the job without understanding what the differences are and how to avoid problems. Remember that no one forces someone to take a job, we did away with open slavery a long time ago.

    They cannot take anything out of a drivers pay unless they have written authorization to do so. They are not really supposed to pay an "Employee" with a 1099 either unless the law has changed?
