It is my understanding (as per a discussion with my own lawyer), that recording phone calls relating to business between you and your employer (client, customer ect) is not illegal and your employer (client, customer, ect) has NO EXPECTATION of "Privacy".

Why do you think businesses "Warn" you that your phone call may be recorded for "Quality Control". That gives YOU the opportunity to end the call.
In addition: phone calls on a speaker phone using such tecnology such as (NEXTEL) "Direct Connect"; ect in a public place devoids the "Expectation of Privacy" as well.
Not like I know the law or am a LAWYER, that is what I was told and of course, if you have any questions ask your own lawyer, I am sure he will tell you the same thing I was told.

I have a BETTER one!
Take the phone into the bathroom, we ALL know that small room has quite an echo. Sit on the "throne" for a few minutes and while in "conversation", grunt and/or groan a few times. Spin the toilet paper roll a few times (spin it BACKWARDS, or you will have to re-wrap the paper), stand up and ask the person calling "Hey, do you know if <insert your favorite word for $4!#> is supposed to be THAT color?"
SIGH very loudly, flush the toilet and drop the seat lid down. Be sure to drag this out for 15 or 20 minutes, I guarantee that if he is still on the line at this time, he wont ever call back. -

"Uh...yes....this is Bob Abooie from J.B. Hunt, and I would like to make a complaint about a person who I just had a telephone conversation with. I think that what they did to me is a violation of Federal law."
"I see...and what was the nature of the violation?"
"Well...Um...How do I put this?...."
"Please...just state what it was. I'm quite shockproof."
"The guy at the other end of the phone was actually in the bathroom while we were talking. He was rather graphic in speaking about what he was doing, what it looked like, AND he passed gas TWICE. I'm deeply disturbed about all of this."
"I'm sure you are. Tell me, did you call him, or was it the other way around?"
"I called him."
"I see. Is this person someone you know?"
"Uh...no."
"What was the nature of the call?"
"I'm a recruiter for a company, and I was calling to offer him a job."
"I see. Pardon me, but what company did you say you were with? I need it for the report."
"J.B.Hunt."
"Thank you. Please hold a minute." <pause> "Mr. Abooie?"
"Yes...I'm here."
"Are you aware that there have been more than 700 complaints filed by people against your company for telephone harrassment?"
"Uh...no."
"I'll put this in the record, but I don't think it will go anywhere. Oh...hang on a minute. My boss needs to speak with you."
"Hello...Mr. Abooie?"
"Yes?"
"I used to be a truck driver. It's been quite afew years since I drove, but somehow, you people have been able to latch onto my home phone number, which is unlisted by the way and I'm looking into that one myself. For five years I have been inundated with call after call from you people. I've asked repeatedly for these calls to stop, and that has failed to produce the desired result, so I have only one thing to say to you."
"And what's that?"

You are quite correct about JB Hunt's attitude to "disavow" and/or cut-loose (by firing) the offending driver if he/she was found to have carried out an illegal directive of a JB Hunt fleet manager or dispatcher. It was my experience that JB Hunt would fire both the driver and the fleet manager or dispatcher when questions arose regarding illegal acts directed by JB Hunt management personnel. I recommend to all professional drivers to log time legally and to drive legally at all times and avoid situations in which you could be "encouraged" by JB Hunt management to drive illegally or perform illegal activities.

While it may or may not be legal to record the telephone conversations between drivers and JB Hunt managers, recorded telephone conversations fall under state legal statutes and therefore laws vary widely from state-to-state. For example, here in North Carolina only one person has to be aware that the telephone conversation is being recorded for "legal" telephonic recording (i.e. the person recording it). However, in many states, all parties involved in the telephone conversation must be notified and their consent to record given before a telephone conversation can be recorded.
In addition, just because a conversation is recorded and "legal" does not mean that it could be used in evidence in a court of law. This sort of evidence is only admitted at trial at the discretion of the presiding judge or magistrate.
Finally, your comment regarding the fact the companies record telephone conversations of their employees and that companies tell you this in their recorded message at the beginning of the call indicates to me that recorded telephone conversations can only be made in many states with the knowledge and permission of all parties involved in the telephone conversation. Therefore, if you fail to notify the person you are talking to that they are being recorded, you may run afoul of strict state statutes regarding recorded telephone conversations or "wiretapping" laws.
Last, I always found it entertaining to tell JB Hunt management to wait a minute while I flipped the recording tape to the new side during "questionable" telephone conversations. It was always my experience that the JB Hunt managers I spoke with changed their inappropriate tone of voice immediately or avoided further illegal directives in short order after being informed that there was a possibilitiy that they were being recorded. I have observed that a bright light tends to scatter JB Hunt management ####roaches thoroughly. -

I can quickly summarize why you should not work for JB Hunt. JB Hunt promises all things but delivers very little. JB Hunt management personnel encourage drivers to drive illegally. JB Hunt requires "legal" logging of time in their words and their driver's manual, but their management personnel suggest ways to illegally log time that they expect drivers to use. JB Hunt pays pretty well, however after two to three months on the job, your miles will drop off significantly and you will find it hard to make a descent living. JB Hunt promises to pay for a lot of extras that, in reality, they do not pay for at the level they promised or sometimes do not pay for at all. JB Hunt has a dismal record regarding driver hometime and you will be "extremely" unhappy when you do not make it home on-time for an important life event. JB Hunt is a large corporation and you will only be a very "small cog" in an enormous wheel and your voice will not be heard. JB Hunt mamangement shows no respect for professional drivers and basically considers them to be a "lower form of life". Last, if JB Hunt wants to hurt you or stop you from future driving jobs, JB Hunt management personnel will "doctor" your DAC report in such a way that you will be unlikely to be employed by another trucking company (95% of medium and large trucking compaines use the DAC report to pre-screen potential driver employees). If the above reasons are not enough for you to stay away from this "bad player", by all means go to work for them and learn by on-the-job experience. I am sure we we see you back at this site if you choose to work for JB Hunt complaining about them and wondering why you did not take the advise written here in the first place. -

The best way to rid yourself of the repeated offerings of the JB Hunt recruiters is to tell them that you consider their repeated telephone calls harassing behavior, that you do not wish them to call again, that you have told JB Hunt recruiters not to call in the past, that you have retained an attorney in the matter to sue JB Hunt for telephone harassment and that you are putting them on hold while you get the phone voice recorder device to document their name and the fact that they are soliciting for employment on behalf of JB Hunt. At that point, I have a good idea that you will not be troubled by JB Hunt recruiter calls in the future. -
What you describe Burrows could be about 29 other companies I know of as well.
I know C.R. England was famous at one time for suckering O/Os into their lease-operator program, giving them tons of miles their first year or so, and then cutting them off at the knees when they were about through with their obligations. Many guys lost their trucks in that scheme. I think the same thing was going on at Dick Simon.
I will say again what I've said before: It really is a "miracle" that one of these outfits hasn't seen an ex-driver go "postal" on 'em. Surely it's just a matter of time before that happens.
