NOPE the on-duty time does not count. I wish you could tell me exactly what you did on the log grids and I will see where you messed up if at all.
I have seen many rookie auditors come to the conclussion of what you did wrong however they did not look to see if the log was entered in incorrectly, which happens all the time.
So if you can do this from your last 10 hour break that you had
I was
driving from 8:00 am to 10:00 am
line 4 10:00 am to 11:00 am
and so on and so on
You may have shortened one of your breaks by 15 minutes or went over your driving by 15 minutes.
Or prior to 10-2005 you had to finish a split in the sleeper regardless if you was at home for 24 hours. Now that is not the case.
But either way the violation would be showing on all driving time after that. But if you can let me know the date of the violation and what you did. Or if you can post the images would be more awesome![]()

I am at home for a few days and my log book is in the truck. When I go back out I will look it up and post something. They use some scanning program to generate the reports. My guess is they didn't pick up that that last 15 minutes was not driving. It was my only violation in 3 months other than logging a fuel stop wrong.
So I can run right up to the 14 and then log a posttrip showing 14.25 hours worked? That wouldn't be legal for the 70 would it? -
It is legal at any point to be on line 4. So yes you can be on line 4 passed your 14 & 70 hour. Now the 70 hour rule the catch there is this
Say today you work (line 4) passed your 70 hour by 30 minutes. Tonight # midnight you are only gaining 10 hours. Well because you was over 30 minutes you have to take 30 minutes from that 10 you have available tomorrow. Basically your re-cap will give you the answer I hpe you do one before you get behind the wheel every day.
Sounds great. Sounds like the computer picked up a line incorrectly somewhere and it caused a false violation or their computer is not set up correctly and please feel free to let me know and I will tell you where to print the information from and show it to the log auditors of course they will probably blow you off so you might need to go to the safety director and if they don't listen keep going. l.o.l. I think it was a key in error and she/he doesn't know the rules very well. I could be wrong though so lets wait and see what your log says that's what counts the most here -
Thats good to know that I can drive right up to my time for the day. I have been planning my day allowing for 30 minutes in pre/post trips if its tight. If i start the day with 10 hours I plan for 9.5. Its usually not too tight. I drive a tanker and they usually give me plenty of time dispatching at 50 mph. I have shut down as much as an hour and a half earlier than I wanted to because I thought I couldn't make it to the next truck stop without being over. That 15 min would have made a difference

I am also a little confused.....on split logging my rule book says that off duty and sleeper berth cannot be split...is this right?
